General Terms and Conditions
BY PLACING A BID YOU ARE AGREEING TO THE FOLLOWING TERMS AND CONDITIONS
Online Auction: Matt Ramsey Auctions is providing an Internet auction as a service. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Matt Ramsey Auctions or anyone else if the internet service fails to work correctly during the online auction. Matt Ramsey Auctions will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy (max bid) bidding feature and leave their maximum bid at least 24 hours before the auction closes.
Buyers Contract: By placing a bid, you have entered into a contract and you are responsible for paying all amounts due to Matt Ramsey Auctions. If you cannot pay for and pick up the items during the times specified, then you must not bid. A valid credit card may be required for bidding approval. A credit card may be required for auction registration to verify the identity of our bidders and to protect the integrity of our bidder's pool. Property Condition: All property is sold "as is." Matt Ramsey Auctions attempts to describe the merchandise to the best of our abilities; however, we make no representations or guarantees. In no event shall Matt Ramsey Auctions be held responsible for having made or implied any warranty or merchantability or fitness for a particular purpose. Matt Ramsey Auctions will not be responsible for any errors or omissions in the description of the merchandise. Bidders shall rely upon their own inspections. All sales are final.
Auction Adjustments: Matt Ramsey Auctions reserves the right to group, modify, increase, diminish or delete lots at its' sole discretion. Matt Ramsey Auctions reserves the right to cancel, suspend, extend or reschedule an individual item and/or auction event and/or to make changes to the auction closing times or inspection or removal times. Some of the items in Matt Ramsey Auctions may have a minimum bid to enter into the bidding. Others may be treated as a reserve bid item. Others may be sold absolute, regardless of price, to the highest bidder.
Close of Auction: You will receive an invoice via email after the auction ends with confirmation of items won with the purchase total and applicable fees.
Tax Exemptions: Sales tax will be collected on all items. If you are exempt from paying sales tax (a reseller or tax exempt entity) your exemption certificate must be on file with Matt Ramsey Auctions or we must collect sales tax. With the proper documents (copy of sales tax license) you may fill out an exemption form at the time of payment. If your exemption certificate is on file prior to bidding, billing will automatically not add sales tax and will make check out much faster.
Payment: We accept cash, check, or credit card (Visa, Discover, MasterCard, and American Express). Credit cards are processed with a 3.50% credit card transaction fee. Cash and check payments accepted on settlement day during scheduled hours. Payment outside of scheduled pick up times must be prearranged with Matt Ramsey Auctions. As the auction host, unless payment arrangements have been made before the end of the scheduled settlement, Matt Ramsey Auctions reserves the right to charge purchase price, buyers premium charges, state tax, and any applicable handling fees to the credit card that you submit at the time of registration.
Settlement and Transfer of Possessions: Property to be settled for and removed within times set forth in Auction Information. Removal at buyers risk and expense. Please bring the necessary assistance and vehicles/trailers required to load and haul your items. You will be required to provide a copy of your paid-in-full receipt before you will be allowed to remove any items from the property.
Failure to Pick Up Items: All items must be removed from the premises at the designated times. IF YOU FAIL TO PICK-UP ANY ITEMS on the days that have been scheduled and you have not contacted Matt Ramsey Auctions and made other arrangements, YOU WILL BE CONSIDERED TO HAVE FORFEITED THE ITEMS AND TITLE WILL REVERT TO Matt Ramsey Auctions. Matt Ramsey Auctions may, in its' absolute and sole discretion, dispose of the items. Matt Ramsey Auctions reserves the right to charge the credit card on file for the full amount of the bid placed upon the items(s), plus any taxes, shipping costs, handling fees, moving or disposal charges that may apply. By bidding you hereby authorize Matt Ramsey Auctions to charge your credit card for any of the fees listed above. If need be.
Registration
If this is your first time bidding online with Matt Ramsey Auctions you will need to create a HiBid user account and register for the auction before you can bid. You will need an email address to create a HiBid user account. Click "Login/New Bidder" on the menu at the top of the page and follow the instruction to create a HiBid user account. You will then need to click "Register to Bid" for the specific auction you intend to bid on. A credit card may be required for auction registration to verify the identity of our bidders and to protect the integrity of our bidder's pool (you do not have to pay with the credit card, please see payment options). Thank you for your cooperation. Please bid early to ensure you are completely registered.
Max Bid: When you bid on a lot, you may choose to place a max bid (maximum bid) representing the highest amount that you're willing to pay at the moment. The automatic bidding technology will then place bids on your behalf. It will always place the lowest bid necessary and never go higher than your max bid. If you're the first to place a bid on a lot without a reserve price, the bidding technology will place the lowest accepted bid amount for that lot. If you bid on an auction with a reserve price, the bid agent will try to bid the amount of the reserve price so you can actually win the auction. If someone bids against you, the bidding technology will attempt to bid one bid step higher so as to give you a possibility to win the auction. Again, it will never bid higher than your max bid amount. During the auction, you can raise your maximum bid at any time: Just place a new bid for a different amount. You will never bid against yourself, even if you increase your max bid. If two bidders end up placing the same bid, the max bid placed or edited first wins. So it is recommended to place your max bid as early as possible.
Staggered Close: Bidding will close at the time set forth in auction information, however, all items do not close together at that time. Items will close in the order listed on the site, (unless affected by the Soft Close as explained below) and typically close at the rate of one to four items per minute. Our Auction was set up this way intentionally so that bidders can have time to evaluate their overall progress in a sale as individual items close. You may also click on "Live Catalog" to view, in real time format, the lots that have current activity.
Soft Close: In order to give our buyers the best opportunity for a winning bid, we utilize the soft close feature in our auctions. FOR EXAMPLE, If an item receives a bid within the last 1 minute, then the close time will be extended 1 minute from the time the bid is placed. The time will continue to be extended for 1 minute with each newly placed bid and the item will not close until 1 minute have elapsed with no additional bid activity. This eliminates snipers from our internet auctions. We have taken every precaution to set the site up in a transparent manner that allows for the fairest environment for both buyers and sellers.
