REGISTRATION & BID NUMBER ACCEPTANCE: By registering and accepting a bid number online or at auction site, the bidder acknowledges they have received, read, understand and agrees to be bound by the terms and conditions of Auction posted online in this document or available at auction site.
ONLINE BIDDERS: When you sign up for a bidder number your credit card number will be retained and charged for your purchase(s), unless previous arrangements with management are made prior to auction day. By clicking the accept button online, you enter in to a binding legal agreement with Auction Sales Co. Auction Sales Co. is providing Internet online bidding as a service to Bidder. Bidder acknowledges and understands that internet service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co. or anyone else if their Internet service fails to work correctly before or during the auction. Internet bidders who desire to make certain their bid is acknowledged should use the Pre bidding feature and leave their maximum bid 24 hours before the auction closes.
GENERAL TERMS OF AUCTION: It is the bidder's responsibility to preview and inspect the items prior to bidding/buying and determine the condition of the item they are bidding on. All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as announced by the auctioneer at time of auction. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. It is important that the buyer avail themselves of the inspection periods. All items sold "AS IS" meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co. will pass on any information, good or bad, that the seller gives to us in describing the items. However, it is up to buyer to determine the condition of the item they are bidding on. All sales are final. When a bidder is awarded the winning bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item. AUCTION SALES CO. RESERVES THE RIGHT TO WITHDRAW OR RE-CATALOG ITEMS IN THIS AUCTION.
PAYMENT: Payment in full is due Auction Day unless previous arrangements with management have been made. Auction Sales Co. accepts cash, credit cards and checks if we have done business with you in the past. If you are a first time customer, a letter of guarantee from your bank is appreciated with a check. Purchases cannot be removed from the auction site until paid for in full. If paid for with non-certified funds, items will not be released until funds clear our bank.
BUYERS PREMIUM: Premium will be added to EACH LOT purchased at the following rate:
Items selling up to $5000.00 - 10%
Items selling from $5001.00 to $10,000 - 5%
Items selling from 10,001.00 and above - 2.5%.
CREDIT CARD PURCHASES: An additional 3% processing fee will be charged for any card used. We accepts: Visa, Master Card, American Express and Discover. Your credit card number will be retained, for this sale only, and charged for your purchase(s), unless pre arrangements with management are made prior to close of auction.
REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. Items may be picked up on Auction Day until 7 pm, and the week following the Auction 8am - 5pm. All items must be picked up by 5pm Saturday, June 29th, 2019. ANY ITEM(S) LEFT AFTER 5PM JUNE 29th, 2019 WITHOUT PRIOR ARRANGEMENTS BEING MADE WILL BE DEEMED ABANDONED AND WILL BECOME THE PROPERTY OF AUCTION SALES CO.
PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE COVERAGE FOR ALL ITEMS PURCHASED.
The purchaser hereby agrees to indemnify and hold harmless Auction Sales Co. and the seller, against any and all liability, loss, costs, damages and other expenses arising from attending the auction or the loading out of equipment by Auction Sales Co. on the purchaser's behalf.
All lots must be removed within the time announced or posted at the sale, at purchaser's sole cost and risk, and only in a manner approved by auctioneer.
Prior to the commencement of loading, dismantling, rigging or cutting or any operation affecting buildings or land, purchaser shall furnish certificates, satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal, shall itself be removed with the purchased lots.
All rights, privileges and powers reserved or granted to auctioneer in these Terms of Sale shall be deemed reserved and granted to auctioneer's employees, advertising representatives, and all owners for whom the lots are being sold.
Auctioneer does not accept responsibility for the failure of any equipment sold to meet the safety standards on classifications of equipment by the Department of Labor Safety and Health Regulation, Federal OSHA or the Environmental Protection Agencies. It is the express responsibility of the buyer to determine what safety equipment must be in service on any machinery purchased and to comply with these regulatory requirements prior to using any equipment, machinery or vehicles purchased from Auction.
In the event Auction Sales Co. is required to employ an attorney to enforce any term of the agreement, purchaser agrees to pay reasonable attorney's fees, in addition to all court costs.
Every person at the auction site before, during and after the auction acknowledges that he/she is there at his/her own risk with notice of the condition of the premises. No person shall have any claim against the Auctioneers, their agents, employees, sellers, owners or principals for any injuries sustained or for any damages to or loss of property which may occur from any causes whatsoever.
ANNOUNCEMENTS: Please listen to the auctioneer for special announcements. The catalog has been prepared only as a guide and the accuracy cannot be guaranteed or warranted by the Auctioneers or Auction Sales Co. All measurements are approximate. Any announcements made by the Auctioneer on auction day will take precedence over the contents of any printed material.
