Auction Terms & Conditions
Absentee bidders will be charged a 2.5% buyer's premium with a maximum of $100.00 and there is no buyer's fee for onsite bidders.
You may place a maximum bid online and a member of our staff will bid for you during the live auction. You are placing an absentee bid. **Please know that a high bid online may not result in winning the lot, as onsite bidders can go above your maximum bid.** Absentee bidders with the high bid after the live auction will be notified after the last lot in the live auction.
Cash, Certified Check, Debit Cards or Major Credit Cards are accepted. Use of a Credit/Debit Card will be charged 2.49% if swiped onsite or 3.49% if charged online. Sales Tax of 10.083% will be charged to winning bids unless item is tax exempt and a tax exemption card is provided. All sales are final upon the award of the bid at which time payment is required. The item(s) WILL NOT be released until payment has been received in FULL by the auction company. Payment can only be made in U.S. dollars. In the event the buyer fails to pay the full invoice price of any item(s), or fails to comply with any other terms of sale, the items will revert back to owner. If the Bidder fails to pay, they may be "black flagged" by the Auction Company and be unable to participate at any future auctions unless they pay for the item(s) in full.
NO WARRANTY: All items sell AS IS, Where IS, Without Guarantee of any Kind. The auction company will describe items in advertisements and during the auction in good faith and as represented by the Seller, however it is the Buyer's responsibility to inspect all property to determine age, condition, genuineness, value and other attributes of the property. Descriptions and any statements made by the Owner (or his agents or officers) or the Auctioneers (or his agents or officers) concerning any item shall in no way be construed as a warranty, either expressed or implied. Pictures are for reference only. D-S Auction Company, LLC shall not be responsible for errors and omissions in the description of any item. Any announcements made on the day of the sale take precedence over all matters.
BUYER'S RESPONSIBILITY: After a bidder has won the bid with his/her high bid, they have become the new owners of the item. The Auction Company or Seller is not responsible to provide any type of protection or insurance on the item(s).
INJURY AND DAMAGE: Bidder acknowledges responsibility for any personal injury or property damage caused by the Bidder or his Agent during pick up, and further agrees to hold Auctioneers and consigner harmless from any personal injury to himself or his Agents and any property damage incurred on auction premises.
D-S Auction Company, LLC is providing internet pre-auction bidding. Internet bidders who desire to make certain their bids are acknowledged should use the HiBid bidding feature allowing them to leave their maximum bid before the auction ends.
LOADING/SHIPPING/UNCLAIMED LOTS: No shipping for items is available unless it has been pre-arranged with D-S Auction Company, LLC prior to the auction close. It is the responsibility of the winning bidder to pick up their purchases during pick up day on Saturday, May 25, 2019 at the conclusion of the auction or Sunday, May 26, 2019 from 9:00 a.m. to 3:00 p.m. Please make arrangements prior to bidding if you cannot pick-up your item May 25th or May 26th. Items not picked up within 7 days become property of D-S Auction Company, LLC. See Auctioneer if you must leave any items longer, and storage fees may apply.
AGENTS ONLY: The Auctioneers are acting as agents of the Sellers.
D-S Auction Company, LLC has the right to accept or deny bidders from attending their auctions online.
All Sales are final. The bidder is responsible for knowing which items he/she is bidding on.
