Inspection of items is highly encouraged. Bidders are required to make their own inspection of the items that they are bidding on. All descriptions of the items are believed to be correct and have been conscientiously described by a reliable source, however the auctioneer or seller does not guarantee said descriptions. Placing a bid on an item is the Bidder's acceptance of the condition of the item based on their inspection of the item whether inspection was done in person or online. The failure of Bidder to inspect the items does not constitute grounds for dispute. Please ask all questions prior to bidding. 2) “AS-IS”: All items are sold as is, we try to tell you what we know about them, if you have specific questions, please call before the auction closes, do not wait until afterwards. 3) SHIPPING is offered on select/limited lots, not all lots have shipping available, see each lot description to determine which lots qualify for shipping and what level of shipping is available. A) There are 4 levels of shipping: 1) $15 SHIPPING AVAILABLE – $15.00 per PACKAGE handling fee plus the cost of shipping and insurance. The increased handling fee is due to either the size or the fragility of the item being shipped and enables us to take greater care in the packaging. Credit card charges and claims will be processed through Shipping Saint. 2) $6 SHIPPING AVAILABLE - $6.00 per PACKAGE handling fee plus the cost of shipping. For shipping of small items, if staff determine that multiple lots can be shipped in one reasonably sized box, then there will just be a one-time $6 handling fee, however, staff have the final say in what qualifies for this and is done at the discretion of the auction company, call with questions, the only way to insure coins or precious metals is by USPS Registered Mail. They can be shipped with or without Registered Mail service, but will have no insurance without that service. Credit card charges and claims will be processed through Shipping Saint. (FOR KNIVES - Be aware of your state laws, if it is not legal to receive or own specific types of knives (switchblades/automatic, butterfly, etc), DO NOT BID, if we cannot legally ship a specific type of knife, we will not ship them and you will not get a refund.) 3) SHIPPING NOT AVAILABLE 4) GUNS - see terms below, all shipping of guns must go through an FFL dealer, no shipping on ammo. If you are a Kansas Resident and are the winning, guns must be picked up on the scheduled pickup day, we cannot hold guns, if you do not pick up on the scheduled date, you will have to go through the FFL Dealer to get the gun (CALL WITH QUESTIONS). Griffin Real Estate and Auction Terms and Conditions 4) AUCTION TERMS & CONDITIONS A) These Terms and Conditions constitute a CONTRACT between you, the bidder, and us, the Auctioneer. Do not submit any bids unless you understand and agree to ALL terms of this contract. B) Griffin Real Estate and Auction shall be known individually and collectively as "Auctioneers", or "Auction Firm". C) All bidders must be 18 years of age or older and register with a valid credit card to bid on this auction. All bidders and others participating in this auction agree that they have read these terms and agree to be bound by and abide by these terms thereby. Bidder and his or her agents and employees agree to assume all risks of damage to person or property. Bidder and his or her agents and employees specifically release and forever indemnify Auctioneer, it's employees, agents, and assigns, from any liability and causes of action. D) All property is sold "as is, where is" without any warranty or guarantee, expressed or implied. ALL SALES ARE FINAL. THERE ARE NO REFUNDS, EXCHANGES or REFUSALS, ALL SALES ARE FINAL. E) As the bidder, by agreeing to the terms and conditions of the auction, you are giving consent for the email registered on file with HiBid to be used for all communication with the Auctioneer, unless the Auctioneer is notified differently. F) As the highest bidder, you are the buyer and are bound by the terms and conditions of this agreement and sale. In no event shall a bidder or buyer hold the Auctioneer responsible for having made or implied any warranty or merchant ability or fitness for any specific purpose G) The Auctioneer is acting solely as an agent for the Seller(s). The Auctioneer shall assume no liability for representations made, or information provided by the Seller(s). The Seller(s) reserve(s) the right to accept or reject any or all bids. This is a Public Auction and as such, all qualified bidders may bid, including Griffin Real Estate and Auction owners, family members and employees. H) Bidders are encouraged to inspect all items before bidding. Public inspection & preview information is posted on our website for each sale. I) Bidder registration numbers are issued solely to individuals and are not transferable. Others are not authorized to use your bidder registration. Should you allow others to bid under your number, you will be fully responsible for all bids they make as though you made them yourself. J) Removal of any and all items shall be at the expense, liability and risk of the purchaser. All property must be removed within the time period stated by the Auctioneer for each auction unless otherwise agreed to and arranged between buyer and seller. Property not removed within the announced time period will revert to the Seller for resale or disposal, without refund or recourse to the bidder. Property not removed shall be considered abandoned and no refunds shall be issued. The Seller, at his or her discretion, may choose to have unclaimed items removed or disposed of at the expense of the Bidder who failed to collect the items. K) The Seller and the Auctioneer reserve the right to withdraw items from sale before or during the auction without prior notice. L) Persons attending the preview or inspection period, or during the removal period assume all risks of damage, injury, or loss to their person and or property, and release the Auctioneer and the Auction Firm from liability thereof. Neither the Auction Firm nor its principals shall be liable for any defect in or condition of premises on which the auction is held. The Auction Firm is acting solely as the agent for the Seller(s) and is not responsible for any acts or omissions of its principals. M) The bidder / buyer agrees to reimburse the Auctioneer for all expenses incurred in the collection of any unsatisfied debt in conjunction with this auction. N) Any Bidder who fails to perform as required under these terms and conditions may be banned from this or any future auctions. O) By registering for any auction, the bidder agrees to be added to the Auctioneer's email list. If you choose to unsubscribe, please follow the link at the bottom of each email to update your notifications. 5) VEHICLES & EQUIPMENT A) **Vehicles and equipment are sold "as is" with no warranty. The Auctioneer does NOT inspect vehicles or equipment, and makes no claim as to the condition of any vehicles or equipment. Some vehicles and equipment may be described as "started" or "ran". This is for informational purposes only, and is a representation of a past occurrence. There is no warranty or guaranty that the vehicle or equipment will start or run again. Bidders should not make buying purchases based on this information. B) Unless otherwise announced, sales taxes are NOT assessed at the time of sale on titled vehicles. Sales taxes will be paid when the vehicle is registered at the DMV. C) Minor mechanical work may be done on the grounds, limited to changing or inflating tires, and jump-starting the vehicles. 6) PAYMENT A) A 10% Buyer's Premium will be added to the high bid on all items to determine the final purchase price of that item. B) Visa, MasterCard, Discover, and American Express are accepted. C) Credit card used to register for this auction will be charged upon the end of the auction for all purchases. D) By participating in this auction, buyers expressly agree that they will not "charge back" or "deny" a credit card purchase. E) There is a $40 service fee that will be assessed for any credit card that is declined for a purchase. 7) PICKUP A) SHIPPING available on select lots labeled “Shipping Available”. Please be sure to look at each lot to make sure that shipping is available, shipping is not offered on every lot, SHIPPING is offered on select/limited lots, not all lots have shipping available, see each lot description to determine which lots qualify for shipping and what level of shipping is available. a. Each lot is marked individually for shipping, if you request shipping on an item that is not marked for shipping, and the auction company determines they will ship it, additional fees and terms will apply. B) Items not picked up during the designated pick-up times will be deemed abandoned and will revert back to the seller with no refunds. There will be scheduled pick up times for each auction please refer to this information and pick up items at that time and that time only. 8) ONLINE AUCTIONS A) Neither the Auctioneer nor the Seller shall be responsible for any failure of any electronic or internet systems to accept or register a bid. Registered bidders must create a password that prevents others from using their account. Bidders are responsible for ALL bids placed under their name and password. This is a Public Auction and as such, all qualified bidders may bid, including Griffin Real Estate and Auction owners, family members and employees. B) Online auctions use a "Dynamic" ending process. If a bid is received in the last few minutes before the scheduled closing of an item, the timer on that item will extend, and will continue to extend each time a bid is received. Once the bidding stops, and the timer runs out, that item will be eligible to close. In some cases, items are "linked", keeping one item open for bidding when a different item in the auction has been extended due to active bidding. C) It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor of all items. Auctioneer may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Auctioneer be held responsible for having made or implied any warranty of merchant ability or fitness for a particular purpose. Auctioneer does not guarantee any appraisals, gradings or certifications. If you have any questions about the merchandise, contact the seller(s) and ASK THEM BEFORE BIDDING. Bidders shall be the sole judges of value. It is Bidder's responsibility to determine if any item is legal where they live. D) By placing a bid, Bidder acknowledges that he or she has inspected the items to his or her satisfaction or chooses to not examine them at his or her sole risk. Even though an item may display as "sold" on the internet, no sales are final until they are certified by the Auctioneer and the bidder receives an invoice. Auctioneer reserves the right to cancel any or all sales and resell the items in whatever manner he or she chooses. E) Bidding increments are automatically adjusted based on the chart provided for each auction, and are subject to change at the sole discretion of auction company. F) Bids cannot and will not be removed or altered, unless in the opinion of the auctioneer, the bidder can establish that the bid was an obvious typographical error. G) Internet bidders who desire to make certain their bid is acknowledged should use the proxy bidding feature and leave their maximum bid at least 24 hours before the auction closes. Auction Company reserves the right to withdraw or re-catalog items in this auction. H) Some of the items in this auction may have a minimum bid to enter the bidding. Others may be treated as a "reserve" bid item. Others may be sold "Absolute", regardless of price, to the highest bidder. I) EXPLANATION OF STAGGERED CLOSING & SOFT CLOSE (this is for a INTERNET ONLY AUCTION) different types of auctions have different types of closings, for example, a WEBCAST AUCTION, has a closing just like a LIVE AUCTION, whoever the auctioneer has in as the high bidder, is who has the bid, even if there is a tie, it goes to the auctioneers discretion): a. Staggered Close: If you'll notice in the Title of our Auction, it states that bidding BEGINS to close at a certain time (for example 2:00pm CDT (Kansas Time). However, ALL items do not close together at that time. Items will close in the order listed on the site, (unless affected by the Soft Close as explained below) and typically close at the rate of 2 items per minute (every 30 seconds). Our Auction was set up this way intentionally so that bidders can have time to evaluate their overall progress in a sale as individual items close. You may also click on "Live Catalog" to view, in real time format, the lots that have current activity. b. Soft Close: Additionally, if an item receives a bid within the last 1 minute, then the close time will be extended 1 minute from the time the bid is placed. The time will continue to be extended for 1 minute with each newly placed bid and the item will not close until1 minute has elapsed with no additional bid activity. This does eliminate "snipers" from our Internet Auctions. Please be certain that we have taken every precaution to set the site up in a transparent manner that allows for the fairest environment for both buyers and sellers. c. Griffin Real Estate and Auction (Auction Company) is providing an Internet auction as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Auction Company or anyone else if the Internet service fails to work correctly during the online auction. Auction Company will not be responsible for any missed bids from any source. 9) SYSTEM FAILURE: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, the Auctioneer reserves the right to extend bidding, close the bidding, or continue the bidding. Neither the Auctioneer nor the online bidding software and service provider shall be held responsible for a missed bid or the failure of the software to function properly for any reason. The Auctioneer reserves the right to cancel, suspend, extend or reschedule an individual item or auction event. The auctioneer reserves the right to make changes to the auction closing times or inspection or removal times. Email notifications will be sent to registered bidders with updated information as deemed necessary by the Auctioneer. " 10) ADD OR DELETE ITEMS: Auctioneer reserves the right to add or delete items from the auction listing at any time. 11) UPDATED FIREARMS TERMS A) GUNS - All state and federal gun laws apply, Legal Kansas residents can pick up guns with no FFL transfer, out of state bidders require an FFL transfer on all guns (see online auction terms for specifics, shipping and transfers not available in all states). No shipping on any ammo. Shipping is not available on all lots. READ ALL TERMS and call with questions. Guns must be picked up on the scheduled pickup day. Buyer will be required to fill out an in-house registration at pick-up and provide the following information, but not limited to: a) Buyer’s name; b) Driver’s License; c) SSN; d) Address; e) Signature; f) Verify that you are of the legal age of 21 for the purchase of a handgun; and 18 years of age for the purchase of a long gun; g) Proof that you are a Kansas resident; h) And have never been convicted of a felony. If you are not able to pick up your gun at the scheduled pick up time, you will have to go through the local FFL dealer and pick it up through them and complete all paperwork/requirements as determined by the FFL dealer. D) OUT OF STATE BUYERS: a. After the close of the auction and within 3 days, please contact the auction company. The following information will be required: 1) your name, address and phone number, and 2) the name of the FFL that will be receiving the gun in your state (name, address and phone number and copy of their FFL License). The fees to ship your gun from our FFL Dealer (THE ELMDALE TRADING POST LLC, 1122 210th Rd, Elmdale, KS 66850) are as follows: A) a $25.00 transfer fee, B) a $25.00 packing, C) a $25.00 shipping fee with $100 insurance, D) if you want additional insurance, you will be charged for the difference, E) If paying with a credit card for all fees a 4% convenience fee applies! Charges will be collected by the auction company and the gun will be shipped/transferred by the local FFL dealer to your. Buyer will also be responsible for any of the charges by their local FFL dealer upon pickup. E) After 7 days, the firearm will be considered abandoned. All local, state & federal gun laws apply. If you are not supposed to own/possess a firearm or for any reason cannot pass any required background check, please do not bid. There is no refund if you are unable to meet these requirements. Markings/Grades on lots that are not from a “Professional Grading Service” are not guaranteed. The auction company does not represent those markings and you as the buyer will need to determine your own gradings and adjust your bidding accordingly. c. There is no guarantee or warranty implied or expressed that the grading standards of current lots will meet the standards of any grading services in the future. It should be noted that consensus grading is employed by most grading services. Grading is not an exact science. In fact, it is entirely possible that if a lot is broken out of the plastic holder and resubmitted to another grading service, or even the same service, the lot could come back with a different grade assigned.
