Terms and Conditions of Border Discount’s Online Auction Sale
Acceptance of Terms: By participating in this auction, you agree to abide by these Terms and Conditions, as well as any additional terms provided in the auction listing.
Eligibility: To participate in the auction, you must be at least 18 years old and legally capable of entering into binding contracts. Certain auctions may have additional eligibility requirements, which will be specified in the auction listing.
Registration: All bidders must register for the auction before placing any bids. During registration, you will be required to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Bidding Process
Bids: Bids must be placed using the auction platform. Bidding increments and reserve prices, if any, will be outlined in the auction listing.
Automatic Bidding: Some auctions may feature automatic bidding where the system will place bids on your behalf up to your maximum bid amount.
Cancellation: Once a bid is placed, it cannot be canceled or modified.
Auction End Times: The auction end time is specified in the auction listing. Bidding may be extended if a bid is placed in the final moments of the auction to allow all interested parties a fair chance to participate.
Winning Bid
Determination: The highest bid at the end of the auction, subject to reserve prices or other conditions, wins the item.
Notification: Winning bidders will be notified via email or through the auction platform. Payment instructions will be provided.
Payment
Terms: Payments must be made in full at the close of the auction. Payments not received within 48 hours of the end of the auction will result in forfeit of the item and restriction of the buyer from future auctions. Bidders must ensure the accuracy and consistency of both billing and shipping addresses on the payment platform and HiBid account.
Fees: Additional fees such as but not limited to taxes, shipping, and handling may apply.
Item Description and Condition
Accuracy: All items are sold AS IS. Descriptions and photographs of items are provided for informational purposes and are believed to be accurate. However, no warranty or guarantees are made regarding the condition or authenticity of items.
Inspection: Bidders are responsible for determining the value and condition of the items and are encouraged to inspect the items.
Shipping and Pick-up
Responsibility: The winning bidder is responsible for the shipping costs and any applicable taxes or duties. Shipping arrangements will be specified in the auction listing. Items will ship out from Laredo, Texas.
Risk of Loss: Risk of loss or damage to the item transfers to the winning bidder upon shipment.
Pick-up: Fully paid items may be picked up in Laredo, Texas. Please e-mail us for the location address. Items must be paid in full within 48 hours of the end of the auction. Items not picked up within 5 business days of the end of the auction will be considered abandoned, and no refunds or credits will be assigned.
Returns and Refunds: ALL SALES ARE FINAL. NO REFUNDS. NO CREDITS. NO EXCHANGES.
Compliance with Laws: All auctions and transactions must comply with applicable local, state, and federal laws. Bidders are responsible for ensuring their bids and purchases comply with all relevant regulations.
Dispute Resolution: Any disputes arising from the auction or these terms shall be resolved in accordance with the dispute resolution process specified in the auction listing or in accordance with applicable laws. Bidders are responsible for any and all fees and losses that result from the dispute.
Modification and Termination: We reserve the right to modify or terminate the auction, these terms, or your participation at any time, for any reason, including but not limited to technical issues, fraudulent activities, or violations of these terms.
Limitation of Liability: We are not liable for any damages or losses arising from your participation in the auction, including but not limited to errors in the auction process, item descriptions, or failures in the auction platform.
