Before you bid, pay close attention to the instructions for merchandise removal, shipping, and location for pick up. These details may change from auction to auction and we do not want our customers to have to pay additional fees for failure to follow directions.
Buffalo Wholesale Inc. will not be held responsible for any interruption in internet service, errors, and/or omissions, caused by any means and does not guarantee continual, uninterrupted or error free service or use of the Site. By bidding with our company you are accepting that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
REGISTRATION
All persons seeking to register to bid acknowledges acceptance of these terms of sale, and guarantees prompt payment of all purchases by cash OR credit card at the time of removal. All sales are Final. All buyers must register. You will be required to enter a valid credit card at time of registration. Your card will be charged $1.00 to check the validity. There is a 15% buyer premium plus local sales tax of 8.75% added to each item. You are required to pay for your items in person during removal dates/times. Items must be paid for in full before they are removed.
Upon credit card approval of the registration fee, and submission of the registration form, such users shall become a ‘Registered User’. Users agree that such information shall be (and kept) current, complete and accurate. If you provide any information that is untrue, inaccurate, not current or incomplete, Buffalo Wholesale Inc. reserves the right to disapprove, suspend or terminate User accounts for any reason, at its sole discretion, and prohibit such User(s) from participating in future auctions.
During the registration process, Users will select a ‘User ID’, and upon successful registration a randomly-generated password will be sent to the email address entered on the registration form. Users are solely responsible in all aspects for all use of the login information provided by Buffalo Wholesale Inc. Users agree to notify Buffalo Wholesale Inc. immediately of any unauthorized use of any Member ID or password, or any other breach of security regarding the Site.
BIDDING
Each auction requires you to login with your username and password prior to placing a bid on a Lot. Making bids with false information or with stolen credit card information is prohibited and illegal. Your user name and password are required in order to place internet bids. Each bid carries the computer coding of the Internet provider which allows the individual user to be traced and Buffalo Wholesale Inc. may at its discretion release this information to enable legal action to be taken. Buffalo Wholesale Inc. may, in its entire discretion, refuse or remove bids where it suspects that bids contravene this Prohibition. Buffalo Wholesale Inc. reserves the right to reject or void bids, whether winning or not, which it believes have not been made in good faith, or are intended to manipulate the auction process, or are prohibited by law.
To bid, click the “Bid” button found on the item you want to bid on. On that button, you will see the amount you must bid to enter the bidding. You can leave a “max bid”; on any item, meaning that the computer will bid for you up to the maximum amount you entered, so you do not have to sit in front of your computer for hours to bid. You may win the item for less than your maximum if other bidders stop bidding at an amount less than your maximum. Remember, we add sales tax and buyer’s premium to your bid.
Once the system accepts your online bid, you have entered into a binding contract with Buffalo Wholesale Inc. and are obligated to pay for your winning bid(s). By bidding, you are agreeing to be held personally liable for the bid amount, buyer’s premium, and any other fees or applicable taxes specified in the item description. Bidders agree that bidding on the Site is the legal equivalent of a firm purchase order. Buffalo Wholesale Inc. reserves the right, and you acknowledge and agree to its exercise of this right, to notify third parties, including law enforcement authorities, credit bureaus, other auction companies and industry regulators and authorities, about bidder’s; involved with or connected to fraudulent bidding or the failure to fully pay invoices in accordance with our terms and conditions. The amount bid can be increased but cannot be decreased. Once you have placed a bid, there will be no retractions.
Buffalo Wholesale Inc. makes every effort to accurately describe items. Buyers can refer to the pictures contained in the auction listings or come to a preview day to clarify their understanding of the specific item characteristics. Buffalo Wholesale Inc. cannot be responsible for misinterpretation or oversight by the Buyer.
Once you have placed a bid, there will be no retractions. ALL SALES ARE FINAL. Any item(s) not picked up during scheduled pick up days and times, will be forfeited. If forfeiture occurs the Buyer will be charged the amount of the buyer's premium that is owed. Retraction of bids will not be permitted. DO NOT BID IF YOU DO NOT INTEND TO PAY YOUR BILL OR CANNOT PICK UP YOUR ITEM(S) DURING SCHEDULED/ADVERTISED PICK UP TIMES. We reserve the right to reject any and all bids
RETURNS & WARRANTIES
No guarantee or warranty is expressed or implied as to correctness, description, authenticity or condition to items listed provided in either written or image form, and bidders should rely solely on their own investigation and/or research of the item they place bids on. Narrative descriptions and photographs provided in online auction listings are for bidder convenience only. Buyer will have ample time to inspect items on scheduled preview days and make their own judgements. It is recommended that you inspect items before bidding.
ITEMS MARKED AS “Like New in Box” or “Tested Ok” can be returned if they are BROKEN, MISSING PARTS, OR NOT WORKING. ITEMS MUST BE RETURNED WITHIN (3) DAYS OF AUCTION. ALL OTHER ITEMS ARE SOLD AS IS.
PAYMENT
This auction will use a “soft close” feature, meaning that if a bid is placed within the last 2 minutes of a lot closing, time for that item closing will extend for 2 more minutes. The Stagger close feature will also be used. Lots are typically staggered between 15-30 seconds.
Upon auction closing, successful bidders will be emailed an unpaid invoice. If you do not see your invoice in your Inbox, check your Spam inbox before calling our office at 716.344.0813. Bidders must bring their form of payment with them to removal. Bidders will then pay at the place/time of removal. All Bidders are required to pay for their purchases before removing any items won in the auction. Your invoice will be needed when you come to the location to pick up your merchandise. Please make sure you have a valid form of payment
We accept Visa, MasterCard, Discover & Cash. There will be a 15% buyer’s premium and NYS sales tax added to all items purchased. Late payment will result in a $25 late fee.Items not paid for within the required time period will be considered abandoned, and will be offered to the backup bidder(s) and/or re-listed in the online auctions. Buffalo Wholesale Inc. reserves the right to offer any merchandise, that was not paid for, to any qualified buyer in order to satisfy the needs of our selling clients.
You agree to pay the full amount of your invoice within three (3) business days after you receive an invoice in your email. Users who fail to pay for their bids within the designated time frame will be subject to Item Forfeiture. If forfiture occurs, buyers could be subject to a 15% penalty and/or offenders account will be subject to Suspension or Termination.
Tax Exemption: Buffalo Wholesale Inc will no longer be accepting Tax Exemption Certificates. If you believe your purchase is tax exempt, you can complete an AU-11 on the NYS Department of Taxation and Finance Website for a refund.
REMOVAL
THERE IS NO SHIPPING FOR THIS AUCTION. LOCAL PICKUP ONLY. Buyers will remove items only on the days and times provided. Please DO NOT BID if you are unable to remove items on the days and times provided. The listed dates and times are the ONLY times for pick up. You will not be refunded due to lack of removal during designated times. Buyers are responsible for bringing their own removal equipment, tools, and assistance. Our staff is limited and may not be able to assist depending on the volume of people being checked out.
Buyer agrees to pay for damages done to any and all property incurred by the buyer, his helpers, employees, family members or friends. Any person attending preview or removal does so at their own risk.
