REGISTRATION: In order to bid, you must register and provide proof of identification. We collect credit card information to prove bidders are of legal age and are qualified buyers. There is no charge to register for an auction.
BIDS: All bids are final. Bidders cannot retract bids. You may enter a maximum bid. The auction software will bid incrementally on your behalf until you reach this maximum amount. If there is a reserve on a lot, you may have to pay a minimum amount to win that item. While most bids are placed online by individual bidders, if requested the auctioneer may enter bids on behalf of telephone or email bidders at their own discretion.
RESERVES: Some items may have undisclosed reserves on them. If a lot does not sell at its assigned reserve the item may be retained by Curated for future sale or may be returned to the consignor.
CONDITION OF ITEMS: All items are sold as is and where is. We try our best to describe items and photograph them well. If you have questions about an item you may contact us or book an appointment for a preview. We reserve the right to remove, edit or add items to the sale at any point during the auction.
NOTIFICATIONS: Bidders may choose to be notified by email if they have been outbid. Select this option when you complete your registration but do not rely on this feature to be notified of bid status. It is the bidder's responsibility to monitor activity on their desired lots.
SOFT CLOSE: We offer a soft close on items. If a bid is made on an item in the last 3 minutes of an auction, bidding will remain open for that item another 2 minutes. Bidding will continue to be extended until no further bids are made.
WINNING BIDS: Winners will be notified shortly after the close of the auction. Winners' credit cards will be charged at that time for the hammer price of the item(s) plus applicable buyer's premiums and sales tax. If shipping is requested, a shipping charge will be added to the invoice using the credit card on file, unless otherwise discussed.
PAYMENT: Winners are charged on their credit cards following the close of the auction. There are no payments made at Pick Up unless otherwise negotiated with Curated beforehand. For some items, at our descretion, a deposit may be required in addition to or instead of a credit card payment. If a credit card is declined we reserve the right to void a bidder's invoice.
PICK UP: Items must be picked up at the specified time and place. Items not picked up will be considered abandoned and bidders may be charged for disposal. Contact us at curated.ptbo@gmail.com to arrange for shipping if you cannot be at the pick up location. We do not provide packing materials, tools, or assistance with removal of objects. Bring materials to pack and transport your winning items. Bring enough people to safely move large or heavy items. Any damage caused to the property during removal of your items may result in a charge to your credit card.
SHIPPING/DELIVERY: Shipping is available for non-furniture items within Canada and to the United States. If you are bidding from another country, please contact us to make sure we can send it to you. Allow 5-7 business days to process shipping orders. Generally shipping orders are picked up by couriers a week after an auction closes. We may require additional time for large and unusally shaped objects. Local delivery is available within Peterborough for $10. For other locations please contact us for a quote.
DISPUTES/CLAIMS: In the unlikely event of a dispute, you agree to accept as true the information that we have in our records. No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an 'as is, where is' basis, with all faults.
PERSONAL AND PROPERTY RISKS: The buyer expressly agrees to indemnify and save Curated, the seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including the negligent acts or omissions of Curated, or anyone acting in their behalf in connection with or arising out of an auction.
USE OF SITE: Bidders acknowledge that Curated auctions rely on hardware and software that may malfunction without warning. Curated may void any sale, temporarily suspend bidding, reschedule an auction, and/or resell any items that were affected by any malfunction. Curated will not be held responsible for any interruption in services, errors and/or omissions caused by any means and does not guarantee continuous, uninterrupted use of the site.
SUSPENSION/ PERMANENT BAN: A bidder may be suspended or permanently banned for providing false information when registering, for failing to honour an auction bid, or for failing to pick up items on their invoice.
By bidding you acknowledge agreement with the terms above. Do not bid unless you agree to the all of the above terms.
