TERMS OF SALE
We thank you for your participation in another FHRA, Inc. auction. It is vital that you familiarize yourself with the terms and conditions as all sales are final, without contingency & irrevocable. The following terms & conditions of sale are non-negotiable. Bid deliberately and with care.
Registration at the auction, whether online or in person, finalizes each bidder's agreement to the following terms and conditions of sale as stated in the Contract and its Addenda which are incorporated by reference into your bidding. Make certain to read the terms and conditions prior to bidding. By bidding you are representing that you have read and agree to be bound by the terms and conditions for this sale as stated herein. To be eligible to bid, you must have registered with FHRA upon arrival, received a Bidder's Card/Paddle Number and have read, thus agreeing to be bound by the terms of sale in the Contract as they are enforceable against you upon becoming a high bidder.
No Buyer's Premium shall be added at this auction.

Bidders guarantee that the information they supply to FHRA Auctioneers is accurate.
FHRA Auctioneers, its Agents and Staff are eligible Bidders and subject to registration, terms and conditions.
Agency Disclosure: The Principal Broker and Auction Company serving as Auctioneer/Agent represent the seller only and do not inspect properties on bidder's behalf. Read the Contract & Auction Day Notes to determine the existence of any disclosures, exclusions, representations & disclaimers. Do not bid if you have not inspected the property. By bidding you agree to any & all disclosures.
This property has new survey performed in 2024.
Your inspection of the property and attendance at this auction are at your own risk. Brokers, Sellers, their agents and employees, expressly disclaim any 'invitee' relationship and shall not be liable to any person for accidents or damage to their person or property while in, on or about these premises, nor shall they be liable for any defects, dangers or conditions on the property. All persons in attendance today shall defend, indemnify, and hold harmless Broker and Seller, their agents and employees, from any and all liability attendant thereto.

Such information contained herein is believed to be correct to the best of both the sellers and Auctioneer/Agent's knowledge but is not guaranteed. Bidders are strongly urged to rely solely upon their own inspections and opinions in preparing to purchase property and are expressly advised to not rely on any representations made by the Seller or their agents and employees. Property information may change without prior notice and potential purchasers should investigate all data fully before relying upon it.
A 10% deposit shall be collected from the winning bidder at the close of auction via good personal check or Certified Funds. Remaining purchase price balance shall be due in full at closing via Certified Funds ONLY with transfer of deed.
Closing shall take place no later than 45 Days from today's date. In the event you are the winning bidder who shall be funding your purchase with a bank loan and your lender denies funding that loan for today's sale for any reason including appraisal value or inspections, your 10% deposit shall be forfeited & non-refundable. Buyers & Sellers shall pay their portion of the customary attorney closing costs. Property taxes will be prorated for the current tax year. In the event that the buyer receives said tax bill in the mail, please contact FHRA or the seller to ensure that the bill has been paid.
By accepting the terms and conditions of the auction, all parties agree to indemnify and hold FHRA Auctioneers harmless from any lawsuit based on users' negligence or activities and that any lawsuits/legal disputes in Grayson County are under the jurisdiction of the Grayson County Courts and must be filed in this court.
All sales are final, without contingencies & are "AS IS, WHERE IS" without expressed or implied warranty both surface and subsurface. Announcements made the day of auction or published on the Internet prior to the stated online auction completion date and time shall take precedence over previously published material and oral statements.
