1. As a Registered Bidder, YOU are responsible for all Terms and Conditions. If you didn't
READ the Terms, you are agreeing to the terms in their entirety even though you didn't
READ OR SEE them.
2. You must REGISTER with a valid Credit Card in order to receive a bid number to bid on items
offered by John Sisk Auctioneers, Inc. We MUST HAVE A VALID CREDIT CARD that can be
charged for your purchases immediately after it sells to you. If it is denied, we will resell it to
another Buyer immediately. And you will be responsible for any amount that is less that your
final bid. If you're going to use a different card other than the one at HiBid, you need to call
our office 361-456-7771 to give us the information
3. This list is provided for your convenience and mistakes in typing do occur. We do our best to
describe items and note any faults seen but that doesn’t mean there may not be something we
did not see. All items are sold AS- IS-WHERE IS - NO GUARANTEE OR WARRANTY that is
expressed nor implied. The auctioneer is in no way is making any representation as to the
genuiness or authenticity of the items. Descriptions given us were deemed from reliable
sources and therefore used. ABSOLUTELY NO REFUNDS OR EXCHANGES FOR ANY REASON
will be given.
4. PLEASE DO NOT ATTEMPT TO PICK UP ANY ITEMS WITHOUT A PAID INVOICE AND ONE OF
OUR PERSONNEL ASSISTING YOU. Live Preview/Inspection time is May 18th Saturday,
2024 10am- 4pm CST. All sales are final and the bidder is responsible for knowing which item
he/she is bidding on and we recommend each bidder make every effort to confirm item
descriptions to their satisfaction by visual inspection of the photo(s) and take advantage of
viewing day.
5. PAYMENT: Cash, Local Checks with proper ID, Mastercard, Visa, Discover, We will email
you an paid invoice and you MUST bring it with you to check out your items. You must pay
immediately with card you registered with unless you make other arrangements with the
auctioneer. NO REFUNDS FOR ANY REASON. THERE IS A 3% CREDIT CARD FEE
6. If buyer fails to make payment good in full immediately following the sale the Auctioneer
may, at his discretion, Re-Sell such property at public or private sale and buyer shall be
required to pay any loss or expense incurred therein, including attorney fees and court cost.
(Chapter 2 of the Texas Business and Commerce Code) Any legal action arising from
transactions related to any auction conducted by Sisk Auctions, either being conducted
on line or on site, will be conducted in Bee County, Texas, USA and under the current laws
of the State of Texas, USA. All operations of this web page are based in Texas and operated
under the current laws of Texas, regardless of user or operator computer location.
7. This auction sale IS subject to the Sales Tax Laws of this State.
8. Any bidder Buying for Resale, or Farm must have their 11-digit Texas Sales Tax Number
and EXEMPTION APPLICATION with them on pickup day.
9. This Auction is A Soft Close Auction. Which means it will begin to close Friday, May 24th 6pm CST This is a gradual close of items beginning in Lot Order if active bidding is taking place on a lot time will be extended, to give each person time to respond. Neither The Auction Company nor Seller is Responsible for Lost Internet Connections for any reason. The computer Software determines which bid is accepted first when it comes to tie bids.
10. There will be a 14% Buyers Premium added to all purchases. Example: If an item sells for
$100.00, then add 15% =$15.00 =$115.00. Buyer pays sales tax on total.
11. PICK UP TIME WILL BE ON Saturday, September 16th FROM 10AM-5PM
12. This Auctioneer is Licensed, & Regulated under a State Issued Recovery Fund. This
Fund protects both the Buyer and Seller from inappropriate and fraudulent actions
by this Auctioneer. This Auctioneers License #7425. Information concerning this
Recovery Fund or this Auctioneer may be obtained by contacting the State
Department of Licensing and Regulation, P.O. Box 12157, Austin, Tx 78711, or by
calling 512 463-2906, or TDLR.gov This doesn't imply endorsement by the State of
Texas.
13. These Terms and Conditions are subject to change at anytime and Sisk Auctions recommends
that they be reviewed periodically to keep up to date on any changes. When placing any bid
we remind you to review these terms.
