Harrington's Auctioneers & Appraisers Terms & Conditions 1. All bidders and buyers must present required documentation before being approved for this auction. 2. This auction includes items with either "no reserve" or "reserve" pricing, as specified in the item description. "No reserve" items are guaranteed to sell regardless of the winning bid, whereas items with a "reserve" have a minimum bid price that must be met to sell. 3. All items are sold "as is" and neither Harrington's Auctioneers & Appraisers nor the listing agent make any warranties or representations of any kind regarding the property. Neither party shall be held responsible for the accuracy of the property's description, genuineness, authenticity, provenance, period, culture, source, origin, or condition, and no statement made during the sale, in the bill of sale, invoice, catalog, or elsewhere shall be considered a warranty or representation or an assumption of liability. Prospective buyers are encouraged to inspect the lots in which they are interested. 4. Harrington's Auctioneers & Appraisers will contact the winning bidders with shipping information after the auction. The buyer will pay the shipping cost indicated in the auction description, as well as any applicable taxes, duties, or fees for items originating from outside of the buyer's home country. 5. The highest bidder, as determined by Harrington's Auctioneers & Appraisers, shall be the purchaser, except as provided in paragraph 1. In the event of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may, at their discretion, either withdraw the lot or reoffer it for sale. The auctioneer also reserves the right to refuse any bid or to refuse to acknowledge any bidder. 6. All merchandise must be paid for directly to Harrington's Auctioneers & Appraisers upon receipt of the invoice. Invoices will be sent the day after the auction. All merchandise must be removed from Harrington's Auctioneers & Appraisers within fourteen business days of the auction. Harrington's Auctioneers & Appraisers shall not be liable for any damage to property left on its premises for more than fourteen business days after the sale. If any property is not removed within fourteen business days, Harrington's Auctioneers & Appraisers may, at their discretion: (a) transfer the merchandise to a bonded warehouse, and the purchaser agrees to pay all transfer and storage expenses, or (b) place the merchandise in a subsequent auction without reserve, to be sold to the highest bidder, and after deducting the standard commission and any additional charges, remit the proceeds to the purchaser. 7. Acceptable forms of payment include VISA/MasterCard, American Express, PayPal. The invoice must be paid in full. Harrington's Auctioneers & Appraisers reserves the right to hold merchandise until the funds have cleared. 8. If the purchaser breaches any of their obligations under these terms and conditions, including the obligation to pay the full purchase price, Harrington's Auctioneers & Appraisers may exercise their rights and remedies under the law, including canceling the sale and applying any payments made by the purchaser to the damages caused by the breach, or offering the item for sale at public auction without reserve and holding the purchaser liable for any deficiency plus all costs of sale. 9. Upon request, Harrington's Auctioneers & Appraisers may, at their discretion, package and arrange delivery as directed by the purchaser. In such an event, the purchaser agrees that all packaging, handling, and delivery is at their sole risk and that Harrington's Auctioneers & Appraisers shall have no liability for any loss or damage to the items. 10. A premium of 25% of the final bid price will be added to each lot sold and must be paid by the buyer as part of the purchase price. 11. Bidding on any item indicates acceptance of these terms and all other terms printed, posted, or announced at the time of sale. 12. All sales are final, and no refunds will be granted.
