The offering and sale of property by Estate Downsizing Specialists, LLC (EDS) is subject to the following conditions of sale, as modified or supplemented by other written provisions and/or in announcements made by the auctioneer, prior to or at the time of the sale.

BUYER’S PREMIUM: All bidders will pay an 18% buyer’s premium. Buyer’s Premium for Specialty and Automobile Auctions may vary, see individual auction descriptions for details.
REMOVAL of PURCHASED LOTS: Items may be removed from the auction house by the buyer after the invoice has been paid. Removal shall be at the expense, liability, and risk of the purchaser. EDS shall not be responsible for items not collected by close of business on the Friday of the week of the auction. Lots not paid for and/or removed within this time frame may be resold at public or private sale without further notice.
PAYMENT: EDS accepts cash, major credit cards, Zelle, wire transfer, personal checks (with a hold until payment clears) and certifiable funds. Nothing will ship until payment is clear and certified to our bank.
Buyers will be contacted via email by Shipping Saints after the auction closes; buyers must click on SHIPPING or PICK UP within this message. EDS makes every effort to contact buyers, however, it is the buyers' responsibility to communicate with EDS to arrange pick up or shipping. Purchased items will not be stored at the EDS facility beyond the week of the auction and will be considered forfeited.
Gold, Numismatics, Sterling Silver or purchases over $500 REQUIRE CONFIRMED FUNDS for new buyers with EDS, such as ACH, Bank or Wire Transfer, as well as proof of identity. Restrictions on shipping of gold and other items may apply. The full purchase price and all applicable taxes and fees are required before removal or shipping of any items.
REQUEST FOR INFORMATION: Requests for additional information and/or photos will be handled as received. Timely replies may not be possible if received within the final 3 days before an auction closes.
TERMS OF SALE: A bid on any lot offered by EDS indicates the buyers’ acceptance of the Terms of Sale. Any participation in the auction binds you to the agreement of these terms, whether you read or understand said terms. The Terms of Sale in writing contained herein are subject to change without notice. The bidder agrees that the most recently published Terms of Sale, as published or amended on the website at the beginning of the auction, shall apply.
DISCLAIMER: All items presented for sale are estate or downsizing items and are used merchandise unless specified as new. Do not assume anything will be included with used items unless they are described and pictured in our listings. Neither we, nor the consignor, make any guarantees, warranties, or representation expressed, or implied, regarding the property or the correctness of the description, of the authenticity of authorship, physical condition, size, quality, rarity, importance, provenance, exhibition, literature, or historic relevance of the property or otherwise. No statement anywhere whether oral or written, shall be deemed as a guarantee, warranty, or representation. The consignor and EDS make no representation or warranty as to whether the purchaser acquires any reproduction rights in the property.
RETURNS, DESCRIPTIONS and GRADING: EDS staff are not professional graders or experts, though we make every effort to give our best analysis of condition, grade, and quality. Items graded by third party grading companies such as PCGS are listed as described by the grader. All items are sold as-is and all sales are final. EDS makes no warranties or guarantees of condition. It is the responsibility of the bidder/buyer to establish the authenticity, grade, details, flaws, provenance, and authenticity of all lots by personal preview. Because of the level of fraud encountered in this industry, it is important that buyers understand this responsibility prior to bidding. All sales are final.
YOUR BID IS A CONTRACT TO BUY: Bidding in an EDS Auction is your contract to purchase. Effective and enforceable immediately when you become the high, winning bidder, you have agreed contractually to your purchase per the laws of the State of Indiana. All bidders must be 18 years of age or older and competent to conduct a financial transaction. EDS makes every effort to accurately describe all lots. We will make every effort to accurately describe all items - descriptions, marks, identification, and photographs of the items will not be considered a warranty or guarantee of authenticity or value. All auctions are considered reserve auctions unless otherwise posted. EDS and its employees reserve the right to bid on any item for any reason, including absentee bids placed by non-internet bidders. The bidder/buyer agrees to pay all costs associated with any collection process for funds due to EDS. This may include legal and court fees, time, and ANY associated costs. The purchaser agrees that a fee of 10% per month will be added to the balance of any unpaid amount due to EDS. This will include ANY and ALL costs associated with collection, including damages.
NEW LOTS MAY BE ADDED: New lots may be added to any of our auctions up to the Friday before the Monday close of the sale.
BIDDING: Auction lots will have a staggered ending time starting at 6pm or 7pm EST, depending on the season, with most auctions closing on Mondays and Wednesdays. All EDS auctions have soft closing times. Stagger time varies per auction depending on the total lot count. Any bids placed in the last two minutes of time remaining will extend the total time. If two bidders place high bids that are the same amount, the FIRST recorded bid becomes the winner. Make sure you have the high bid before assuming you have purchased an item. EDS assumes no responsibility or liability in the bidding activities during the close of the auction. Once an item is closed, EDS cannot change the winning bidder status under any circumstances. EDS reserves the right to withdraw any bid for any reason.
ADDITION TO OR WITHDRAWAL FROM SALE: Seller or Auctioneer may withdraw or change the items being sold in this event at any time and at their discretion.
SALES TAX: 7% Indiana Sales Tax will be charged for all buyers with Indiana residence. If you have a Tax Exemption, we must have your Exemption Certificate on file before the close of the auction. No Lots will be released on a Tax-Exempt basis until EDS has a current copy ON FILE. Certificates can be emailed to EDSOnlineAuctions@Gmail.com.
SHIPPING: In-house shipping is available on some, but not all, lots. Additional charges will be due and paid separately for shipping and handling. See the Shipping/Pick Up tab for more information.
TECHNOLOGY DISCLOSURE: EDS has created an Internet Auction environment for buyers. This technology, along with your personal Internet connections and equipment, can fail. In the event you are unable to complete the bidding process for any reason, EDS is not liable to any bidder for loss of time, expense, or damages. By registering for this auction, the buyer/bidder agrees to hold EDS harmless for any damages or expense due to technology malfunctions. EDS is an agent for our Seller(s) and in no way represents the buyer/bidder legally. EDS reserves the right to withdraw any bid for any reason. Bidding in this auction creates a binding contract obligating the buyer/bidder to complete the purchase transaction per the Terms of Sale listed here.
