Terms and Conditions
Auction Terms & Conditions 1. THANK YOU for registering & bidding at our Auction. 2. EVERYTHING MUST BE PAID IN FULL BY END OF AUCTION regardless of when it is picked up. PLEASE NOTE PICK UP DATES/TIMES. Item Pick-Up and Storage Fees: Customers are required to pick up purchased items on the designated pick-up day specified by the auction house. Failure to do so will incur storage fees of $10 per day starting from the day after the designated pick-up day, unless alternative arrangements are made in advance with Auction House Staff. If accumulated storage fees exceed the original purchase price of the item, the auction house reserves the right to reclaim the item and resell it at auction.3. Everything will be sold "as is, where is", with no guarantees of any kind, regardless of any statement of condition made from the Auction block. Buyers shall rely entirely on their own inspection and information. ALL ITEM ARE USED EXCEPT were denoted in writing on lot information. 4. Preview dates/times please see "dates" section. 5. The Bidder is responsible for knowing which item they are bidding on. If bidder is unsure, they should inquire or not bid. When you become the winning bidder at Auction you have affected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor "mistakes". 6. INSPECTION: It is suggested that all items be inspected prior to bidding on items. Anyone seen moving items will be viewed with suspicion and can be asked to leave. 7. Everything must be removed in time frames specified. Buyers are required to remove purchases within the time frames posted. If you are unable to pick up your purchases in the allotted time frames, do not bid at this auction. All purchases must be paid in full before items will be released from the premises. Buyer must provide their own labor, materials and packing supplies. Auction Company DOES NOT have staff on hand to help you load your purchases. Buyer must provide its invoice and I. D. at time of pickup. 8. Failure to Remove Purchases. In the event items are not removed in the time frames allotted, the items purchased shall be deemed abandoned and Buyer will lose any right, title or interest Buyer may have acquired and the items shall revert and repossess to Auctioneer without further notice to Buyer. Auctioneer shall also be entitled to any costs associated with the removal, storage and reselling of Buyer's items, and any other charges, fees, and expenses incurred because of Buyer's failure, including all attorney fees and costs incurred by Auctioneer to enforce Buyer's obligations hereunder. 9. Representations. All items are being sold AS USED, As-Is with no warranty. Exact counts are not guaranteed All count is approximate and it is the bidder's responsibility to inspect and verify the count. Auctioneer shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. On-site inspection of items being sold is always recommended. Auctioneer makes every effort to provide accurate information about the items being sold. However, neither Auctioneer nor its Client will assume responsibility for Buyer's bidding errors. It is Buyers' full responsibility to confirm the accuracy of items offered for sale. Buyers are recommended to inspect all items. Descriptions and photos are offered as a guide only. Do not rely solely on photos to make buying decisions, be sure to read descriptions. Auctioneer shall not be held responsible for such errors as posting the wrong photo for an item. When in doubt about the condition of an item, please bid accordingly. 10. All Sales are Final. A successful bid at auction, whether live or online, constitutes a legally binding contract of sale. All sales are final. There will be no refunds, returns or exchanges. 11. Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the seller. 12. The Auctioneer reserves the right to reject the bidding of any person whose conduct, actions, or adverse comments he feels are not in the best interest of the seller or other bidders. 13. Plain clothes security personnel are present and any person caught tampering with tags, rearranging merchandise, or shoplifting, will be vigorously prosecuted! 14. Non-Delivery. Until such time as purchased items are removed from the premises by the Buyer, Auctioneer shall have the right to cancel or void the sale of any such items purchased by Buyer. Auctioneer shall have no liability to Buyer due to the non-delivery of any purchased item other than the return of Buyer's deposit for a canceled or voided sale item. No claim of any kind for purchased items, whether or not based on negligence, shall be greater in amount than the purchase price paid by Buyer. 15. I understand that a 6% Internet fee is charged & due AND 4% credit card fee, which are both my (Buyers') responsibility and due and payable immediately upon close of Auction. 16.BUYER PAYS ALL SHIPPING AND PACKING CHARGES DIRECTLY TO THE MAIL CENTER. 17. Any dispute will be resolved by the Auctioneer and that decision will be final. 18. CHECK OUT: NOTHING CAN BE REMOVED UNTIL FULL PAYMENT HAS BEEN MADE. 19. All announcements from the Auction Block will take precedence over any printed matter, with the exception of "condition" as outlined in paragraph 3. 20. I understand this is used merchandise and there will NOT be chargbacks. Buyer MUST rely on their own inspection and information. Buyer will pay for any & all litigation, if necessary plus all court costs, collection and attorney fees and interest incurred. 21. I understand that violation of any of these Terms and Conditions will result in prosecution in Indian River County, Florida. 22. Auction Company, Auctioneers and Staff represent the Seller(s). 23. Any claims will be settled by binding arbitration in accordance with Indian River County mediation and the FAA and NAA codes of ethics. 24. If I become the high bidder and fail to pay for my items, I will be liable for liquidated damages in the amount of 100% of my bid price, plus all court costs, collection fees, attorney fees and interest in Indian River County and barred from all future and affiliate auctions. 25. If you need clarification on any items in the Terms or Conditions, or the procedures of this Auction, please ask prior to bidding. 26. Dealer Administration fee will be due on all titled vehicles, equipment as well as required DMV State charges. 27. The Auctioneer reserves the right to drop from his mailing list as well as refuse to give a bidder number to any person whose conduct and presence, he feels, at future Auctions would not be in the best interest of his clients. 28. Most items are used merchandise. ALL items have NOT warranty or guaranty of any kind. The condition of the items being offered varies. The Buyer understands and agrees: (1) that any description or sample of the items given or furnished by Auctioneer is solely for identification, and does not create any warranty expressed or implied, that the item actually conforms to such description or sample, (2) that Buyer or agent on Buyer's behalf has inspected or has had the opportunity to inspect, all of the items upon which Buyer will be bidding and/or does purchase, (3) that all items are purchased and accepted by Buyer "AS IS", "WHERE IS" and "WITH ALL FAULTS". AUCTIONEER MAKES NO WARRANTIES OR GUARANTEES WHATSOEVER WHETHER WRITTEN, ORAL OR IMPLIED AS TO QUALITY, AUTHENTICITY, QUANTITY, CONDITION, USEABILITY, SALEABILITY, WEIGHT, MEASUREMENT, YEAR, MODEL, MECHANICAL CONDITION, PERFORMANCE, OR OTHER SPECIFICATIONS, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR WARRANTY AGAINST PATENT, TRADEMARK, COPYRIGHT OR TRADE SECRET INFRINGEMENT, (4) in the event there are manufacturer warranties in effect for the item purchased, Buyer must make all claims thereunder directly with the provider of the warranty. No statement or statements of any other paragraph herein shall be construed to in any way contradict the provisions of this paragraph. By registering at this Auction, I understand and agree to all of the above Terms and Conditions. 31.Acts of Others. Persons in attendance during inspection, sale or removal of merchandise assume all risks of damage or loss to persons, property, or merchandise and shall exercise proper precautions at all times for the protection of persons and property and shall comply with all safety and health requirements as directed by Auctioneer, and local, state and federal regulations. Neither Auctioneer, its agents, its employees or representatives shall be liable by reason of any defect in or about the condition of the premises on which the auction is held. Buyer specifically releases Auctioneer, its agents and representatives from all liability thereof. 32. Limits of Liability. In no event shall Auctioneer's liability to Buyer exceed the purchase price actually paid for an individual item or lot. A Buyer's claim shall be limited to the amount paid for the merchandise, and shall not extend to any obligation, risk, liability, right, claim, remedy for loss of use, revenue or profit, liability of Buyer to any third party, personal injury, or any other direct, indirect, incidental or consequential damages. Buyer further acknowledges that each item it purchases at the sale represents a separate transaction, and that no one transaction shall be conditioned upon another transaction. Buyer hereby holds Auctioneer harmless from: (1) the acts or omission of any party who provided any items to Auctioneer for sale, (2) the acts or omission of the owner or Lessor of the auction site or the site where the auctioned items are stored, (3) any claims Buyer may have against Auctioneer, Auctioneer's client(s) or any former owner of the property being sold, (4) Buyer's failure in any way to properly inspect items and/or fulfill its obligations per the terms and conditions of the sale, as indicated within this document or as announced by Auctioneer at the time of sale. In the event Buyer provides a deposit or payment using a Credit Card, Buyer acknowledges that it is purchasing under the As-Is, Where-Is terms of the auction and that Buyer shall waive all rights of charge back based on any claims of misrepresentation, non-delivery or non-performance. 33.Indemnification. Buyer shall indemnify, hold harmless and defend Auctioneer, owners and building owners from and against any and all losses, damages, liabilities and claims, including attorney fees, costs and expenses arising out of based upon or resulting from: (1) failure to secure all safety equipment and to meet all applicable government safety standards in removing items purchased or used by Buyer, (2) failure to comply with safety instructions issued to Buyer from Auctioneer, (3) any act or omission of Auctioneer, owners, building owners or their respective agents, representatives or employees, relating to or affecting the items bid on or purchased by Buyer, (4) the claim of any third party claiming or challenging title to any items purchased by Buyer or claiming infringement of any proprietary interest, (5) the claim of any person resulting from Auctioneer offering for sale or selling the items purchased by Buyer, (6) any injury to Buyer or any other person or property of any type whatsoever caused during the inspection, dismantling, removing or transporting of items purchased by Buyer. 34. Right of Removal. Auctioneer reserves the right to remove any person from the auction site and to refuse that individual's bid, whether offered live, by proxy or by Internet. In such event, any outstanding deposit will be immediately returned. 35. Bidder's Number. The bidder's number is nontransferable. All bids made using the bid number will be the responsibility of Buyer NOTE: This Auction will positively be conducted under the above terms and conditions. HIBID INTERNET AUCTION PLATFORM & WEB SERVICE DESCRIPTION Sebae provides the HiBid (formerly Bidopia) Internet Auction Platform & Web Service ("HWS") under the HiBid trademark as a software solution for auctioneers wishing to extend the audience of their live auctions to the internet. The HWS provides various features including internet absentee bidding, internet-only auctions, and webcast auctions. The HWS is able to changes its appearance to coincide with the website that it is powering. Accordingly, the HWS powers the www.hibid.com website as well as numerous Auction Flex customer websites. This ability to change appearance is a feature of the HWS. Much like internet merchant account providers can host a secure web page for a vendor to easily process payments, the HWS hosts certain portions of the auctioneer's website to easily enable advanced features such as internet bidding. INTERNET ABSENTEE BIDDING Internet absentee bidding allows you to place a bid for an item in advance of an auction. This allows you to place bids on lots without actually attending the auction. INTERNET-ONLY AUCTIONS Internet only bidding allows you to place a bid for an item prior to the auction lot closing online. In an internet-only auction there is no live auction. BIDDING The Service requires you to login with your username and password prior to placing a bid on a Lot. Each bid carries the computer coding of the Internet provider which allows the individual user to be traced and Sebae may at its discretion release this information to enable legal action to be taken. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside. DISCLAIMER OF WARRANTIES You expressly understand and agree that: a. your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Seabee expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. b. Sebae makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the software will be corrected. c. Any material downloaded or otherwise obtained through the use of the service is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material. D. no advice or information, whether oral or written, obtained by you from Sebae or through or from the service shall create any warranty not expressly state in the TAC. LIMITATION OF LIABILITY You expressly understand and agree that Sebae shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Sebae has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service. GENERAL INFORMATION the TAC constitutes the entire agreement between you and Sebae and governs your use of the Service, superseding any prior agreements between you and Sebae. You and Sebae agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Indian River, Florida. The failure of Sebae to exercise or enforce any right or provision of the TAC shall not constitute a waiver of such right or provision. If any provision of the TAC is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TAC remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TAC must be filed within one (1) year after such claim or cause of action arose or be forever barred.

When packing fragile items multiple boxes may need to be used for shipping, to ensure safe transit. Additional boxes required due to the number of items will incur shipping costs, and the customer will be responsible for covering these expenses. If shipping requires multiple boxes to accommodate the total number of items purchased, the customer is responsible for the cost of all boxes used.

We provide professional packaging and transportation services. We will arrange transportation within 3-7 working days after receiving payment. Transportation, the buyer pays the transportation expenses. If shipping is required, you will see 2 different charges on your credit card, 1 for the total for the item, and 1 for the shipping and packing. We will not know what the shipping cost will be until packed and ready to go. Please allow 5-7 business days for processing.
