This property is subject to a partition action and any delay in underwriting title caused by the need to obtain any court order(s) to complete the transaction, will not be cause for termination of the purchase.

Bidders agree to keep their username and password confidential, as they are responsible for any and all activity involving their account. All bidders must be 18 years of age or older.

However, we retain the right to make the Site unavailable from time to time for any reason. Therefore: Heartland Real Estate & Auction shall not be liable for any damages arising from any interruption, suspension, or termination of the Site.
In the event that there are technical difficulties related to the auction platform, server, or any other auction related technologies, Heartland Real Estate & Auction reserves the right to extend bidding or close bidding at any time. Neither the company providing the software nor Heartland Real Estate & Auction shall be held responsible for a missed bid or the failure of the software to function properly for any reason.
Heartland Real Estate & Auction reserves the right to modify the details of this auction, cancel this auction, or remove any lot prior to the close of bidding for any reason including but not limited to technical issues, emergencies, and convenience of the auction firm or seller.
Any buyer or bidder not executing their responsibilities at the conclusion of this auction shall pay Heartland Real Estate & Auction an amount equal to the Buyer’s Premium or commission and any expenses incurred for this auction. The buyer shall also pay the seller any damages caused by said breach of contract including attorney fees and costs. If the buyer defaults on any terms laid out in the purchase and sale agreement, in any manner whatsoever, the earnest money shall be paid first to Heartland Real Estate & Auction for commission and expenses and the balance to the sellers. In the event any bidder defaults, he/she shall be banned from bidding at any other Heartland auctions.
