REGISTRATION & BID NUMBER ACCEPTANCE: By registering and accepting a bid number online, the bidder acknowledges they have read, understand, and agrees to be bound by the terms and conditions of Auction posted online in this document or available at auction site. By clicking the accept button online, you enter into a binding legal agreement with Auction Sales Co., LLC. Auction Sales Co., LLC is providing Internet online bidding as a service to Bidder. Bidder acknowledges and understands that internet service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Auction Sales Co., LLC or anyone else if their Internet service fails to work correctly before or during the auction. Internet bidders who desire to make certain their bid is acknowledged should use the Pre bidding feature and leave their maximum bid prior to the auction closing. Registered bidders are responsible and liable for all bids they place - intentional or accidental.
Lots will have a "STAGGERED" and "SOFT CLOSE". You will be notified by email that you are the winning bidder. Email invoices will be sent as soon as the Auction closes.
What is a "STAGGERED CLOSE"? The lots do not close all at the same time. Lots will have a staggered closing using a mixed sequence. Follow the clock to the right of each lot to know the exact closing time of a particular lot.
What is a "SOFT CLOSE"? If a bid is submitted and confirmed during the last 2 minutes before closing, then the time will be extended on that lot by 1 minute. This will continue until no more bids are placed on the lot.
GENERAL TERMS OF AUCTION: It is the bidder's responsibility to preview and inspect the items prior to bidding/buying and determine the condition of the item they are bidding on. All articles of merchandise are offered "As Is, Where Is" by lot, individually or in groups as they appear in the auction catalog. No claim will be considered for allowance adjustment or rescission of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer. It is important that the buyer avail themselves of the inspection periods. All items sold "AS IS" meaning the bidder is responsible for due diligence in inspecting all items. Auction Sales Co., LLC will pass on any information, good or bad, that the seller gives to us in describing the items. Auction Sales Co., LLC is not responsible for incorrect listing information, if any. However, it is up to buyer to determine the condition of the item they are bidding on. All sales are final. When a bidder is awarded the winning bid on an item, that bidder instantly becomes the new owner of that item and is completely responsible for that item. AUCTION SALES CO., LLC RESERVES THE RIGHT TO WITHDRAW, CHANGE OR RE-CATALOG ITEMS IN THIS AUCTION. ALL MEASUREMENTS ARE APPROXIMATE.
BIDDING - Do not bid unless you agree to ALL of the terms and conditions posted herein. By bidding you are acknowledging agreement with all of the terms and conditions included herein and else where on our website. The highest Bidder shall be the Buyer and no Bidder shall retract their bid. A Buyer is deemed to have accepted an item or lot when they make their bid. A successful bid at auction constitutes a legally binding contract of sale. All sales are final. The acceptable bidding increments are established and controlled by Auction Sales Co., LLC.
Any dispute arising as to any bidding shall be settled by Auction Sales Co., LLC at their sole discretion, and Auction Sales Co., LLC may put the lot in dispute up for sale again. Auction Sales Co., LLC reserves the right to refuse any bid, which it considers to be an insignificant advance over the preceding bid. Certain items in the sale are being offered subject to reserve, which is the confidential minimum price below which such lot will not be sold. Auction Sales Co., LLC has the right to place a bid for the consignor up to the Lot's reserve. Lots that fail to meet the reserve price may be represented for sale in another auction. Auction Sales Co, LLC reserves the right to allow any and all employees to bid.
Auction Sales Co., LLC reserves the right to reject a Bidders registration application and/or bids for any reason in their sole discretion without prior contact to the Bidder. Bidders who do not preview items prior to the auction understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person.
PAYMENT: Accepted forms of payment - Cash, Wire Transfer ($15.00 Wire Transfer Fee will be added to invoice total for Wire Transfer payment), Certified Check, Personal/Business checks are subject to approval and may not be accepted if buyer does not have a positive previous purchase history with Auction Sales Co., LLC., Credit cards (a 3% processing fee will be added to invoice total for any credit card transaction).
If Cash, Wire Transfer or Check requests are not made prior to the close of auction, your credit card on file will be charged for your purchases. You may pay for you purchases at your scheduled load out time if Cash, Wire Transfer or Check requests are made. All payments are due within the stated loadout period for this auction.

TITLED ITEMS -
A $50 document processing fee will be charged by the auction company for each titled DMV purchase, regardless of the purchaser's intended use of the purchase. Funds must be certifiable prior to the processing or release of DMV documents. Title documents will be prepared to be effective only in the jurisdiction in which the auction is being conducted.
REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. Items may be picked up by appointment only. All items must be picked up by the dates listed in this auction's details. ANY ITEM(S) NOT PICKED UP OR PAID FOR BY THE DATES LISTED IN THIS AUCTION'S DETAILS WILL BE DEEMED ABANDONED AND WILL BECOME THE PROPERTY OF AUCTION SALES CO.
Successful bidders will be required to schedule an appointment for their load out. Successful bidders will be sent an email with their invoice which will include a link to sign up for a load out date and time.
PURCHASER SHALL MAKE HIS OWN ARRANGEMENTS FOR INSURANCE COVERAGE FOR ALL ITEMS PURCHASED.
The purchaser hereby agrees to indemnify and hold harmless Auction Sales Co., LLC and the seller, against any and all liability, loss, costs, damages and other expenses arising from attending the auction or the loading out of equipment by Auction Sales Co., LLC on the purchaser's behalf.
All lots must be removed within the stated load out schedule. It is the buyer's responsibility to verify they have loaded all of their purchases. Auction Sales Co., LLC and employees are not responsible for any item left behind by buyer. Any item not picked up or paid for by during these dates will be deemed abandoned and will become the property of Auction Sales Co., LLC. Items will be removed at purchaser's sole cost and risk, and only in a manner approved by auctioneer.
Prior to the commencement of loading, dismantling, rigging or cutting or any operation affecting buildings or land, purchaser shall furnish certificates, satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal, shall itself be removed with the purchased lots.
All buyers, customers, hauling companies, and their agents release Auction Sales Co., LLC, it's employees, agents, and sellers from all liability during the loading and hauling process. Auction Sales Co., LLC will not be held liable for any damages. It is the sole responsibility of the buyer to tie-down loads appropriately and to DOT regulations.
All rights, privileges and powers reserved or granted to Auction Sales Col, LLC in these Terms of Sale shall be deemed reserved and granted to Auction Sales Co., LLC's employees, advertising representatives, and all owners for whom the lots are being sold.
Auction Sales Co., LLC does not accept responsibility for the failure of any equipment sold to meet the safety standards on classifications of equipment by the Department of Labor Safety and Health Regulation, Federal OSHA or the Environmental Protection Agencies. It is the express responsibility of the buyer to determine what safety equipment must be in service on any machinery purchased and to comply with these regulatory requirements prior to using any equipment, machinery or vehicles purchased from Auction.
In the event Auction Sales Co., LLC is required to employ an attorney to enforce any term of the agreement, purchaser agrees to pay reasonable attorney's fees, in addition to all court costs.
Every person at the auction site before, during and after the auction acknowledges that he/she is there at his/her own risk with notice of the condition of the premises. No person shall have any claim against the Auctioneers, their agents, employees, sellers, owners, or principals for any injuries sustained or for any damages to or loss of property which may occur from any causes whatsoever.

Shipping / Pick Up
-The buyer is solely responsible for removal and shipping of their own purchases during the load out schedule for this auction. A forklift will be available to ASSIST in load out. BRING LOADOUT HELP WITH YOU. It is the buyer's responsibility to ensure all items they purchased are loaded.
-Load out is by appt only.

Addresses will be included in your invoice email.
-Loadout appointment link will be in your invoice email sent out after the auction closes.
-Please select only ONE loadout time slot. (You do not need to schedule more than one time even if you purchased items from both the Saturday & Sunday auctions)
-Please understand that load out will not happen without an appointment.
-Successful bidders will receive an email following the close of the auction with their unpaid invoice. That email will contain a link to the LOAD OUT SCHEDULING PLATFORM.
-All items must be paid for and picked up by May 31st at 4pm.
