*Bidder Registration:
Auction Plus, Inc. Reserves the Right to refuse service to any bidders for any reason(s). All bidders are required to be registered and provide a valid credit card upon registration. If a bidder does not show up for a pick-up during the designated time or make shipping arrangements before the end of the pick-up window, That Bidder's Bidding Rights will be discontinued for any future Auctions conducted by Auction Plus, Inc.
*Buyers Contract: All items are sold "AS-IS", "where-is" with no warranty or guarantee of any kind. A bid is a legal binding contract. Buyers are responsible for honoring their purchases and payment is expected in full immediately at the Close of the Auction or before leaving the premises with your items if agreed to by Auction Plus, Inc.
*Buyer will be LOANED a key for access and buyer will have 30-45 Calender Days for Removal and leave the warehouse and other areas ready to be broomed Cleaned.
*Buyer will be Required to Place a $5,000 "Clean Out Deposit" Over and Above the Invoiced Amount Due. This Deposit will Held by Auctions Plus, Inc. Until the Warehouse and Other Areas are left Ready to be Broomed Cleaned at which time the "Clean Out Deposit will be Returned to the Buyer.
*Buyer is Responsible to Remove All Items, Except those Noted in the Lot Discription That will Stay, Incluing any trash or unusable Items.
Auction Closing Schedule: Unless otherwise noted, each online auction closes two (2) items per minute, unless a bid is made within the final three (4) minutes, then the listed item will automatically be extended for an additional (4) minutes.
Bid Increments: Bid increments are as follows;
Opening Bid for this Auction will be $5,000 and Bid Increments will $500 Increments up to and over the Set Reserve Price.
*Payment: Payment for this Auction will be Made in Person with Cash or Via Wire Transfer to the Client Business Account of the Auction Company Along with the buyer's $5,000 "Clean Out Deposit". We will add a 15% buyer's premium to each invoice. No Sales Tax is required to be charged for this Auction.
*Merchandise Pick-up: Pick-up location will be posted on the winning bidder's invoice along with the prescribed pickup time. If you cannot make the pick-up time DO NOT BID! No merchandise will be removed from a location or transferred to another location unless paid in full. Failure to Pick-Up or Pay for Merchandise: If a buyer fails to contact the Auction Manager or show up to pick up their items they will immediately lose bidding privileges. Bidding privileges will only be reinstated when the buyer pays all invoices in full whether or not the merchandise is still available to the buyer. A $10.00 disposal fee may be added to the invoice total.
*Transfer of Merchandise: If a seller agrees to transfer an item for an alternative pick up it is the responsibility of the buyer to arrange pick-up within ten (10) business days. We will not call and remind you. After ten (10) business days the items will be considered abandoned and forfeited and become the property of the seller.
Inspection of Merchandise:All sales are Final No returns! Please inspect your items closely before leaving the property. We do our best to provide descriptions of an accurate nature; therefore it is the responsibility of the buyer to contact us with any questions on an item.
*Untested Merchandise: We cannot test all items; therefore, items sold as "Untested" are sold AS-IS with no warranties expressed or implied.
*Shipping: NOTE- ONLY THOSE ITEMS MAKED "SHIPPING AVAILABLE" ARE ABLE TO BE SHIPPED. ITEMS NOT MARKED WITH FOR AVAILABLE SHIPPING MUST BE PICKED UP BY THE BUYER. Auction Plus, Inc. will only ship items at Bidder's expense that are small enough to be shipped via USPS Priority Mail or Flat Rate Boxes. An additional $5.00 handling fee will be added to each box. When possible, we will combine shipments into one package when multiple items are won by the same bidder. Fragile items, items that weigh over 25lbs., or items that will not fit in a 16½" x 14½" x 12" box will need to be picked up or shipping can be done by a Professional Shipper/Packer at Bidder's Expense. Please contact the auction company if you need a list of Professional Shippers in our area. Buyer must notify the auction company if they plan to use a Professional Shipper/Packer and Buyer is responsible for making their own shipping arrangements with the Professional Shipper/Packer . Shipping and handling costs are the sole responsibility of the Buyer. Shipping and handling charges will be charged upon completion of packaging with the credit card on file. All packages being shipped by the auction company will be shipped with insurance equivalent to the hammer price. Please allow 7-14 business days after the last scheduled pick-up date for items to be shipped. Please contact our office at 440.412.7655 with any questions. No furniture will be shipped!! Winning bidders of furniture must make their own shipping arrangements (including palleting) or take delivery of the furniture items at the auction house.
*Use of Site: Auction Plus, Inc. or it's Sellers cannot, and will not, be held responsible for any interruption in service, errors, and/or omissions, caused by any means and does not guarantee continuous, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning. Auction Plus, Inc., in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of Auction Plus,Inc. is Final.
*Indemnification: Buyer agrees to indemnify Auction Plus, Inc., its affiliates, and/or clients for any damages or losses. Buyer will not hold Auction Plus, Inc.,its owners, affiliates, clients or its employees, liable for accidents, injury, theft, or incidents related to this purchase.
