Auction Terms & Conditions IMPORTANT: Your acceptance of these terms is your promise to read and abide By the Condition of Sale as Printed below. While Auctioneer has endeavored to advertise and describe the property correctly, all property is sold "as is," and neither Auctioneer nor consignor will be responsible for the description, authenticity, genuineness, provenance, or condition of the property. No statement contained in the advertisement, catalog or made orally at the sale or elsewhere shall be deemed to be such warranty or representative or an assumption of liability. All buyers should physically inspect the item prior to placing any bids. No bids can be withdrawn for any reason. The highest bidder acknowledged by the auctioneer shall be the purchaser. In the event of any dispute between bidders, the auctioneers shall have absolute discretion to either determine the successful bidder, in which event his determination shall be final, or to re-offer and resell the article in dispute. If any dispute arises after the sale, Auctioneer's sale record shall be conclusive as to who was the purchaser, the amount to the highest bid, and in all other respects. If the auctioneer, in his sole and final discretion, decides that any original bid, that any advance thereafter is not sufficient amount, he may reject the same. While most items in the auction will be sold without reserve, the auctioneer withholds the right to bid in behalf of each consignor for the purpose of protecting reserves, that is, placed bids during the auction if and when the highest bid is less than the reserve on the lot being offered. No properties purchased during auction may be removed until paid in full and must be removed on sale day or during the time frame of scheduled pickup times, unless special arrangements have been made prior to placing bids. Auctioneer will not be responsible for lost or damaged merchandise and no refunds will be made if lost or damaged. Unpaid invoices past the scheduled pick up days will be automatically settled with credit card on file. Items left past the schuduled pick up days will be considered abandoned and become the property of National Auction. No Refunds Will Be Given. LOT DESCRIPTIONS & CONDITION: National Auction provides lot descriptions and condition details as a helpful resource for bidders. These details are intended to be accurate but are only opinions, not statements of fact, and do not provide any warranty or guarantee regarding the condition of the items. It is important to note that the lot descriptions, listings, photographs, and catalog information are for descriptive purposes only and are not a substitute for a physical inspection. It is the responsibility of the buyer to investigate, inspect and confirm the condition of the items before bidding. A physical inspection is highly recommended. Buyers should rely solely on their own investigation and not on any information provided by the seller or auctioneer. All items are sold "as-is" with no expressed or implied warranties. The inspection should serve as the buyer's guide. Failing to fully inform oneself about the condition of an item will not be grounds for any claim adjustment or cancellation of the sale. PAYMENT: Payment for all bids must be made in US Dollars (USD) and can be done through cash, credit card (3.5% Charge), wire transfer (with a $10 fee), or a personal or company check accompanied by a valid driver's license.Out of state check must be pre approved by National Auction. Out of state checks over $1499 must be have a bank certified letter of credit. Payment must be made on the day of the auction or within the designated pickup days, which can be found under the "Auction Details" tab in the catalog. BUYER PREMIUM: No buyer premium BIDDER REGISTRATION: To participate in the bidding process, you must be at least 18 years of age. During the registration, you are required to provide accurate and complete information for proper identification. It is your responsibility to keep your account information up-to-date. All bids submitted are final and cannot be retracted or removed. RETURNS: All sales are final with no possibility of returns, refunds, credit card charge-backs, or adjustments. NO SHOW BIDDERS & NON PICKED UP ITEMS For bidders who do not show up or fail to pick up their items, the credit card on file will be charged for any open invoices after the designated pickup days. Any items not picked up within that time frame will be considered abandoned and become the property of National Auction, with no possibility for refunds. NON PAYING BIDDERS: Bidders who fail to pay for their purchases or engage in fraudulent bidding will face legal consequences and the possibility of criminal charges, including fraud and violations of interstate commerce. Such actions will result in suspension of the bidding account. LOT GROUPINGS: When bidding on grouped lots/items, it is the responsibility of the winning bidder to take possession of the entire lot. Failing to do so will result in suspension of the bidding account. POSESSION: Once the auction is complete, the buyer assumes full responsibility for the merchandise and any risks associated with it, including loss or damage. If payment is not made, the buyer will be responsible for the original purchase amount, any collection costs, and any damages resulting from the resale of the property. PICKUP INFORMATION: Pickup information can be found under the Auction Details Tab in the catalog. National Auction will assist with check-out and item retrieval, however, it is the buyer's responsibility to load their own purchases. It is important to thoroughly inspect and verify all items before leaving the checkout area, as no refunds will be given for missing or lost items. Unpaid invoices after the designated pickup days will result in automatic charges to the card on file. Any items left past the pickup deadline will be considered abandoned and become the property of National Auction with no possibility for refund. LIABILITY: National Auction and its officers, employees, independent contractors, and clients shall not be held liable for any injury or damage of any kind that may occur during the previewing, bidding, pickup or conducting of business activities. Bidders participate at their own risk and agree to release National Auction and its agents from any liability regarding the condition and location of the property being offered for sale. Bidders are solely responsible for their own safety and are encouraged to exercise caution during preview and pickup. PRIVACY: At National Auction, we take the privacy of our clients seriously. We ensure that all personal information collected from our buyers and sellers is kept confidential and will not be disclosed to third parties without their explicit consent. However, by registering as a bidder, you grant National Auction the permission to send you occasional promotional emails about future auction events.
