1.Payment Options, We accept the following payment methods: cash, bank cheque, EFT, Mastercard, Visa, and PayPal. Please note that a 1% fee applies to all Mastercard and Visa transactions. Payment must be cleared prior to the pick-up of purchased items.
2.Bidding Registration, All bidders must register online and provide their full name, company name, address, email address, phone number, and credit card details. By registering, you confirm your agreement to adhere to the Conditions of Sale.
3.Determination of the Purchaser, The highest bidder, as determined by the Auctioneer in their sole discretion, shall be the purchaser. In the event of any dispute, the decision of the Auctioneer regarding the purchaser will be final. Time is of the essence for each lot sale.
4.Vendor's Right to Bid ,The vendor reserves the right to bid on their own behalf, either personally, through the Auctioneer, or via an agent.
5.Auctioneer and Vendor's Rights, The Auctioneer and the Vendor reserve the right to: cancel, extend, or reopen the online auction; set a minimum reserve price; amend a starting price; withdraw any lots from the sale; refuse any bids; offer part or combined lots; refuse entry or eject individuals from the selling place; bid on behalf of the Vendor or other purchasers; and sell unsold lots through private treaty, subject to these conditions.
6.Bidding Increments and Retractions, Unless otherwise specified by the Auctioneer, every bid must be at least 5% higher than the preceding bid. No bidder is allowed to retract their bid once placed.
7.Payment and Collection, Payment must be cleared prior to the pick-up of purchased items. Goods cannot be removed from the premises until full payment is received, and all lots must be collected within the specified time frame determined by the Auctioneer.
8.Inspection and Disclaimer of Warranty, We strongly encourage buyers to carefully inspect all lots before placing bids. It is essential to thoroughly examine the condition, maintenance, safety, and regulatory compliance of the items. Please be aware that all lots are sold on an "as is" basis, without any warranties or guarantees, expressed or implied. The Vendor and Auctioneer shall not be held responsible for any inaccuracies in catalog descriptions or statements. Buyers accept full responsibility and assume all risks associated with the purchase of lots. We kindly remind buyers to exercise due diligence and buyer beware (caveat emptor) when participating in our auctions.
9.Buyer's Responsibility, Buyers should thoroughly inspect all lots and confirm all relevant details, including measurements, usage history, maintenance records, and regulatory compliance. It is the buyer's responsibility to ensure compliance with their jurisdiction's regulations and bring the machinery up to standard, if necessary, before use.
10.Insurance, No item sold is insured. Buyers are responsible for insuring any purchased item, if required, after the conclusion of the auction.
11.Shipping and Delivery, Shipping and delivery are available upon request for a fee that will be determined based on the size of the order and the location of delivery. Additional fees may apply. Please contact our team to discuss shipping and delivery options and obtain a quote.
12.Liability and Risk, All buyers and members of the public enter the premises of 2nd hand fitness at their own risk. Buyers, their representatives, and members of the public are advised about the potential presence of dangerous machinery, chemicals, forklifts, and other hazards within the auction premises. Individuals may not be familiar with the surroundings, so caution and care are strongly advised.
13.Non-Compliance and Default, If any buyer fails to comply with these conditions, any deposited monies may be forfeited, and any uncleared lots may be stored at the defaulter's risk and expense. The defaulter's items may be resold by public auction or private contract to recover any deficiencies, costs, charges, and storage fees. The vendor and the Auctioneer reserve the right to pursue legal action to recover the price of the goods sold.
14.GST, The knockdown prices of the assets being sold are not inclusive of Goods & Services Tax (GST). The Auctioneer will announce prior to the commencement of the sale whether GST is applicable. In cases where GST applies, a 10% GST will be added to the knockdown prices of all items sold, along with the buyer's premium.
15.Claims and Abandonment, Any claims under these Conditions must be made at or before the time the goods leave the premises. Failure to do so may result in the abandonment of any claim. The purchaser shall be deemed to have abandoned any claim under these Conditions unless a claim is made in a timely manner.
16.Auctioneer's Agency, The Auctioneer acts solely as an agent for the Vendor and shall not be held responsible for any action arising from the sale. The Auctioneer's role is limited to facilitating the auction process and conducting the sale on behalf of the Vendor.
17.Buyer's Premium, Buyers agree to pay a buyer's premium, which is applicable to the auction sale in addition to the knockdown price. The specific buyer's premium rate will be announced and advertised prior to the commencement of the Auction Sale. The buyer's premium is subject to a 10% GST, which will be added to the relevant buyer's premium indicated on the Tax Invoice supplied to the purchaser.
18.Special Conditions, Please note that specific Auction Sales may have additional and more specific Conditions of Sale that are applicable. These additional conditions may include requirements related to site safety, occupational health, removal and collection restrictions, or other relevant factors. It is the responsibility of the buyers to familiarise themselves with any such additional conditions that may apply.
