Read these terms carefully. When you click the "Register to Bid" button, you enter into a binding legal agreement with THE ONLINE AUCTION b) Registering to bid is free. You must provide a credit card during registration for if you pay via hibid (15%). This card will be charged for any items you are high bidder on. Amount charged will include high bid price, Buyer’s Premium ($5.00 min or percentage whichever is greater) and Idaho sales tax. In cases where the primary buyer cannot/does not pay the secondary bidder will take the item and be charged. We do NOT alter tax rates if you'd like your state tax rate you will need to petition the state for the tax amount returned between Idaho and your state taxes. Bidding: a) All bids submitted are final and irrevocable, whether they are submitted in person, online or by proxy. Bids WILL NOT be altered or deleted so be sure to bid on the correct item and for the correct amount every time. If you are the highest bidder you are the new owner of that item. All sales are final. Unless items have a COA they are sold as is and as shown. We cannot guarantee an item if there is no COA (certificate of authenticity). However if an item says something like "it turns on" but it doesn't of course cases like that will be refunded. We do our best to make sure titles and descriptions match as well as weed out any "fakes" or "copies" however WE ARE NOT APPRAISERS. Therefore if a title does not match or descritpion this IS NOT CAUSE TO REFUND, LAWSUIT, OR ANY OTHER FORM OF ARBITRATION. b) Most items are sold without reserves however, any items with a reserve will be declared so the bidder is fully aware that the item has a reserve price and what it is in the notes. If at any time you notice an item that does not have the reserve in the notes please let us know so we can correct that. c) The Online Auction reserves the right to refuse bids from any individual, at any time, for any reason. Successful bidders are required to pay a Buyer’s Premium on each item purchased as well as the taxes unless you have a reseller permit. The reseller permit is REQUIRED BEFORE the auction to have tax deducted. If you offer your buyer permit after auction conclusion your tax will be removed for FUTURE auctions. d) All items are sold “as is, where is.” We make no representations or warranties with respect to the items in our auctions. We recommend that you closely inspect our photos to ensure you’d like to buy before bidding. You may also email us to ask any questions or for specific photos you may require. For this reason damages or condition (beyond that of shipping damage) are NOT cause to recind a sale, refund, lawsuit, or any other arbitration. e) Descriptions are provided to help identify an item and create interest. Descriptions are not complete or exhaustive. It is up to the buyer to determine the condition of the item BEFORE they submit a bid via the photos or via email contact for specific questions. We do our best to make sure titles and descriptions match as well as weed out any "fakes" or "copies" however WE ARE NOT APPRAISERS. Therefore if a title does not match or descritpion this IS NOT CAUSE TO REFUND, LAWSUIT, OR ANY OTHER FORM OF ARBITRATION. f) APPRAISALS & OPINIONS OF VALUE: All values including appraisal prices and auction estimates are to be used as guidance and are not guaranteed by the auction company or the third-party appraisal company. No appraisal or auction estimate should be used as a suggestion of resell value. Opinions of value and quality can vary greatly among "experts" (of which we are not as we are not appraisers) based on current market conditions, availability in the market place, geographical location, gemological equipment types, method of grading and the evaluator's training. Such variances do not constitute any error on either evaluator. THE ONLINE AUCTION does not warranty any opinion of value. Items should not be purchased with the expectation to resell for appraisal price or for profit. Therefore if a title does not match or descritpion this IS NOT CAUSE TO REFUND, LAWSUIT, OR ANY OTHER FORM OF ARBITRATION. g) This is a shipping ONLY auction unless otherwise noted on the item description. ALL ORDERS regardless of distance from auction location or item location WILL BE SHIPPED (again unless otherwise noted on the item description). Keep in mind you will also be charged shipping charges for items you purchase. h) Purchases must be paid in full within 3 business days of auction (which means by Friday). You have 3 days from when tracking notates you recieved your order to let us know of missing items or items that were not working that we claimed were if it applies. WE DO NOT ACCEPT WIRE TRANSFERS OR MAIL IN PAYMENTS. I) Any items not paid for by the Wednesday following auction close WILL be deemed abandoned and sold at a future auction WITHOUT REFUND. Refunds will not be given on abandoned items. In events that we make acception to this rule we are not liable for items that are missing after the 4 days as they should have been resold. WE DO NOT ACCEPT WIRE TRANSFERS OR MAIL IN PAYMENTS. j) If we cannot make available or deliver clear title on a purchase, the buyer is entitled to a full refund of the purchase price upon immediate return of the item. Item must be returned in the same condition as it was prior to the sale. k) Resellers must submit an reseller permit before the conclusion of the auction. Failure to do so will result in sales tax being charged. l) Buyer specifically waves the right to dispute or deny payment for any purchases as you have agreed to payment the minute you bid on the item and have agreed to our legally binding terms given here. m)Submitting a bid signifies your agreement to these terms. If you do not agree to or understand any of these Terms and Conditions, DO NOT BID. For this reason not understanding the agreement or not having read the agreement is NOT cause to Recind sale, refund, lawsuit, or any other form of arbitration. n)Auction end time may be extended at any time for any reason. o) Shipping is done Thursday/Friday following the auction close of every week FOR ALL ORDERS (unless otherwise stated in the item description). We will send you an invoice via Square for payment at a reduced rate. If you do not pay via square within 3 days (Friday) we WILL and have every right to charge your card on file with hibid at a larger fee (15%). We price shop USPS, UPS, and Fedex to get the cheapest shipping we personally are able (WE DO NOT SET YOUR SHIPPING RATES). We use what boxes we have here at our location and cannot guarantee any certain kinds of boxes nor that every item will fit into one single box. We will ship to the location that is on your invoice so please update settings to reflect that. We cannot ship items that are combustable or against federal guidelines. Items that say "shippable" are the ones we will ship. If an item is won that does not say shippable than that specific item is one that must be picked up. If you purchase an item to be picked up contact us via email to set pickup. All shipping is subject to insurance and a signature on every order. If you are the highest bidder on multiple lots, we will combine to save on shipping charges. Cost of shipping cannot be cause to rescind sale, refund, lawsuit or any other form of arbitration. If a package is returned due to non pick-up or incorrect address from the customer, that is to say not by fault of the auction, items will be rerun without refund. p) Blocking: If a bill is not paid and goes into default, you will be blocked from our auction until your debt is collected. Shipping is charged SEPERATE from your order. The only time this will NOT be the case is if you have not paid by Tues/Wed at which point your square invoice will reflect both. If they are not paid by WED night the hibid card on file WILL BE charged at a higher rate (15%).
