Luther Bros Auction Co. LLC - Terms and Conditions Welcome to our auction. These Terms and Conditions govern your use of our auction services, including bidding on and purchasing items through our auction. By using our auction services, you agree to be bound by these Terms and Conditions. Registration To participate in our auction, you must register and create an account on our auction platform. During registration, you will be required to provide accurate and complete information. By registering for our auction, you represent and warrant that all information provided by you is accurate and complete. Bidding All bids are final and binding. All property is sold "As Is, Where Is", and All Sales are Final. There are no bid reversals or refunds. By placing a bid, you agree to pay the full amount of your bid, plus any applicable buyer's premium and other fees. NC Taxes will be added to all sales unless you have a valid TAX ID# on file with us. We reserve the right to reject any bid at any time, for any reason. We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. Prospective bidders have the opportunity to examine items of interest preceding the end of auction. Check the listing for scheduled preview dates and times. Condition reports are offered as a courtesy but they are a matter of opinion and we are not liable for any omissions or errors. It is the Bidder's responsibility to determine condition, age, genuineness, authenticity, value or any other determining factor prior to placing a bid on an item. Bidder shall be the sole judge of value. We may attempt to describe the merchandise in advertising, on the internet, over the phone and at the auction but make no representations, guarantees or warranties whatsoever. Payment Payment must be made in full within 24 hours of the close of the auction. Payments will be collected through the HiBid platform via credit card at the close of auction with card on file, unless otherwise agreed upon in writing. Buyer's Premium A buyer's premium of 15% will be added to the final bid price of all items sold, unless otherwise specified. The buyer's premium is non-refundable and is subject to change at any time. Shipping and Pickup Local pickup is available on Monday, September 18th from 10am-3pm at our auction warehouse located at 3013-G Hall Watters Dr in Wilmington NC 28405. All items purchased that are not picked up or shipped within 7 days of the close of the auction will become forfeited property to the auction house, unless otherwise agreed upon in writing. $10 handling fee will be added to any items that are shipped. Items will be grouped when applicable for shipping. We are not responsible for any damage or loss incurred during shipping. Disputes In the event of any dispute between the buyer and seller, we will act as a neutral third party and will make a final determination on the dispute. Our decision will be final and binding. Liability We are not liable for any damage or injury incurred during the preview, bidding, or pickup process. By participating in our auction, you assume all risks and liabilities associated with these processes. Modification We reserve the right to modify these Terms and Conditions at any time, without notice. Your continued use of our auction services after any modification constitutes your acceptance of the modified Terms and Conditions. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina. Any legal action arising out of or in connection with these Terms and Conditions or our auction services shall be brought in the courts of New Hanover County (NC).
