In order to bid in or on this online auction you agree to be bound by this contract as a bidder. If you place and hold the high and winning bid, your roll as bidder automatically converts to that of buyer. You further agree to be bound by this contract as a bidder/buyer or buyer.

1) Bids are a binding contract between you (the registered bidder; herein after referred to as bidder or buyer) and Heritage Estate Sales. Once a bid is offered, bidder acknowledges to be bound by the high-bid amount the bidder agreed to. A bidder CANNOT withdraw or retract a bid once it has been made. Bidders should carefully verify the bid amount entered BEFORE submitting a bid. Heritage Estate Sales is not liable for bidder data entry/keying errors on any bid amount placed by the bidder or a bidder's designee.
Bidder further agrees and acknowledges that by placing a bid on any item in this online auction that you, as the bidder/buyer, are bound by all of the Terms and Conditions outlined herein. Information contained herein applies to this online only auction only and is subject to change.
Bidder acknowledges and understands that Heritage Estate Sales uses a dynamic bidding process which means if a bid is entered by a bidder within the last two (2) minutes of that item closing, the bid time for that item will be extended by two (2) minutes; this extension is to ensure sufficient time for all other bidders to also submit their bids until the highest bid is achieved resulting in formal closing which is the result of no additional bid being entered during the ending two (2) minute period.
2) Buyer's premium is 15%; this amount will be added to the hammer price. The Buyer's Premium is a taxable amount. Tax may be applied to you, the seller, or Heritage Estate Sales - as the case may be per each individual online auction. Please refer to your receipt for taxing information. If the receipted tax value is zero, this means either the seller or Heritage Estate Sales has assumed tax payment liability for the sale. If the receipted tax value is greater than zero, this means the buyer has been assessed sales tax.
3) Payment of the hammer price, buyer's premium, and taxed amounts, is collected using the credit card the bidder has registered with; the bidder/buyer's credit card will be charged at the conclusion of the auction.
Credit cards accepted include: American Express, Visa, Discover, and MasterCard.
Note to vehicle bidders: Winning bidder/buyer's of any vehicle must make payment via Cash, Cashier's Check from a Local Bank, or ACH. Contact the auctioneer using the information provided on the invoice to set up an appointment for payment and pick-up.
4) All payment arrangements must be made/finalized by 4 PM CST on the business day following the auction end date. Failure to make payment arrangements may result in exclusion from future auctions; determination of exclusion is at the sole discretion of Heritage Estate Sales.
5) All online auction items are sold "As Is/Where Is" with no expressed or implied warranty or guarantee. All items are sold as used, unless otherwise specifically noted.
All descriptions provided are believed to be accurate. Pictures always take precedence in what is included in the lot. Items included in a picture, but excluded from bid will be noted, such as jewelry display boards which are always excluded.
All bidding is based solely on bidder's questions and/or opinion of the item for which a bid is made.
6) This is a public, online only auction offered by Heritage Estate Sales. This and all auctions offered by Heritage Estate Sales is open to any and all registered bidders unless otherwise excluded. Registered bidders may include family members of the estate or employees/associates of Heritage Estate Sales who publicly reserve the right to bid and buy any any auction item.
7) Heritage Estate Sales, its employees, and contracted auction team are all agents of the seller and shall conduct business on behalf of and in the interest of the seller.
8) The winning bidder/buyer is responsible for providing all necessary supplies for the packaging and removal of items from the estate or place of pick-up. Bidder/buyer is responsible for the dismantling of any and all furniture purchased, and for the lifting, carrying, crating, loading, hauling, and/or rigging of any and all items purchased. Bidder/buyer agrees to package and remove items at their own and sole expense and risk. Heritage Estate Sales is not responsible for any damage, accidents, or injuries that may occur during the packaging, dismantling, break-down, removal, loading, hauling/transport, and otherwise removal of any auction item purchased by a bidder/buyer from the estate or designated location/property. The Heritage Estate Sales auction team does not provide load-out or equipment service.
9) Any purchased item not retrieved by the end of the last published pick-up day will revert back to the seller with NO REFUND to the buyer. If the item purchased is eligible for shipping as noted in the description of the item, and the bidder/buyer would like the the item shipped in lieu of pick-up please contact Heritage Estate Sales at the number provided on the invoice provided at the conclusion of the auction by 2 PM CST on the last day of the designated pick-up for the online auction.
10) Buyer agrees to not dispute any credit card charges associated with their invoice from Heritage Estate Sales for their online auction items, buyer's premium, assessed taxes, or subsequently applied shipping charges. Charge disputes may result in exclusion of future online auctions held by Heritage Estate Sales.
11) All winning items are to be picked up from the address/location listed in the invoice or email provided.
12) Shipping is available for small items only. Please advise at the time of registration if shipping is needed for purchased items - use the NOTES TO AUCTIONEER section to provide notation of shipping need. An additional fee will be charged for both shipping and handling, a flat $15 handling fee is charged for all shipped items in addition to shipping charges assessed by the mailing entity. Heritage Estate Sales will use either USPS, UPS, or FedEx for shipping based on the best rate available at the time of shipping. If overnight shipping is needed, please indicate in shipping note. A handling charge of $25 will be added for all overnight requests. All items are mailed beginning the Monday following the conclusions of the online auction.
13) All items placed in the auction are subject to additions and/or deletions prior to the sale/closing time of the item at the discretion of Heritage Estate Sales.
14) Heritage Estate Sales uses a third party entity for all online auctions. Heritage Estate Sales makes no implied or express warranty or guarantees that any user of this site will be able to access and use the site uninterrupted, securely, error-free, or timely. As a third party site, Heritage Estate Sales cannot:
14.1) Guarantee or warrant that results obtained from this site will be accurate or reliable.
14.2) Guarantee or warrant that the quality of information or other material obtained through use of this site will meet your expectations in any way.
14.3) Guarantee or warrant that the use of or inability to use this site will be done so without any unauthorized access to, or alteration of, your transmission or data entered or used on the site.
14.4) Guarantee or warrant any statement(s) or conduct by any third party on this site, or any other matter related to the operation, conduction, access, use, security, or function of this site.
15) In the event of any hardware, software, internet, or other related malfunctions or errors, Heritage Estate Sales reserves the right to cancel any or all transactions, even if a bidder has received a winning bid notice or a buyer has received confirmation invoice via email.
