Bidding Notice: This auction will be conducted online only. Bidding will begin September 7th, 2023. This auction will have a staggering close with lots closing every few seconds beginning at 7:00pm CST on September 19th, 2023 until all items are sold. This online sale utilizes a soft closing which means if you bid in the last minutes of lot closing, the bidding will be extended a few mintues until all parties are done bidding. All sales are final and items are sold "as is, where is". This is an estate auction so please note items are used.
No sales tax will be charged for this auction.
BUYER'S PREMIMUM: 15% buyers premimum will be charged, no matter the form of payment (cash, check, or credit card), to the winning bid to reach final sales price.
PAYMENT: Credit Card used for registration will be charged immediately following the auction unless other arrangements have been made BEFORE auction's end. By registering to bid on any item, bidder agrees to all terms and conditions of the auction. Kail Auctions, LLC reserves the right to refuse to accept bids or approve bidders for any reason.
If payment has not been received at auction end or other payment arrangements made by end of business hours on pick up day, we reserve the right to cancel any unpaid item(s) after that time. At this time, we will ban the bidder from any future sales and resell the item(s) to the back up bidder. Shipping will only be arranged after payment has cleared.
PICK-UP: 9/21/2023 from 10:00am - 6:00pm CST. Space is limited and people will be assisting you in retreving your items around the house. Parking is also very limited and we may only be able to assist one customer at a time. Please be patient. You must pick your item(s) up at the stated times if you do not you will release your item to be resold or sold to the back-up bidder. This does not mean you are released from paying for items you won at auction. SO if you cannot pick up your items on the specified pick-up day , DO NOT bid. Contact us if you need other arrangements.
PREVIEW: 9/17/2023 from 1:00pm-4:00pm CST. All lots are sold "AS IS, WHERE IS." Property shall be displayed for thorough public inspection and sold as is, where is, and without recourse for any refund or reduction of the sale price.
On the fall of the auctioneer's hammer or other acknowledgment of a successful bidder on a lot, title to the property in that lot will pass and the successful bidder there upon assumes full risk and responsibility for the purchased property. The highest bidder shall be the buyer. If any dispute arises, the auctioneer shall have absolute discretion to settle it and put any disputed lot up for sale again. Kail Auctions, LLC has full discretion to refuse any bids.
SHIPPING: If you need shipping please contact us at kailauctions@gmail.com or call 731-514-1258. Shipping will be offered on SMALL ITEMS ONLY! Shipping will be conducted by us or by a third party. Shipping includes pick up fee, wrapping and shipping charges. The third party will be The UPS Store 230-B Tyson Ave, Paris, TN 38242, Phone: 731-644-8771 Email: store3525@theupsstore.com. Please note your order may take some time to prepare please be patient with the shipper and us. Once your order has been delivered to the UPS store, it is YOUR responsibility to contact them, and pay for your order to be shipped. Please also note, if we have to pick your order back up from UPS, we will charge your credit card $20.00. So please consider this when you bid. UPS cannot qoute you how much shipping will be unless they wrap your order, hence, why we make sure you want shipping beforehand. We USE UPS ONLY as a third party shipper. On some occasions, we ship in house, in those cases, you will be contacted for card info to be charged for shipping charge if conducted by us. If you do not attempt to make contact reguarding shipping or the UPS store cannot reach you via the info provided through HiBid within a reasonable ammount of time, your items will be thrown away. Kail Auctions or the 3rd party shipper do not have room to store items.
Online bidding is a convenience offered to customers and while we make every effort to execute your instructions regarding your Online Bids. Kail Auctions, LLC is not liable or responsible for any errors or failure to execute such instructions. Kail Auctions, LLC reserves the right to cancel, postpone, or extend the auction at their discresion.
STORAGE: We have no storage. Your items must be picked up at address of sale. We will not haul your items unless it is to the UPS store.
DESCRIPTIONS: All descriptions are subjective and up for interpretation. Please note you are responsible for looking at all photos and reading descriptions. We offer a preview day for in person inspection of the items being offered for auction.
TECHNICAL PROBLEMS: We have made reasonable efforts to provide for online bidding for this auction. You recognize and acknowledge, however, that technical problems with hardware, software, or internet connectivity, as well as human errors, may arise and may affect, without limitation, the Kail Auction's HiBid website, our online bidding program and process, your or our internet service and access, and your connection to this auction’s bidding program and process. You further acknowledge that these and other technical problems may develop at any time and with or without notice. You acknowledge and agree that neither we nor the Seller is in any way responsible for any such technical problems, and that you have no absolute or other right to be able to bid on this auction in the event of any such technical problems. Notwithstanding the foregoing, you further acknowledge and agree that, in the event of any such technical problems, we reserve the right to postpone or cancel the auction and/or extend the bidding time for this auction and/or relist the property for auction at another time, in our sole discretion, and that our decision with regard to any such actions is and will be final.
All legal disputes or any litigation's that may arise, for any reason, between Kail Auctions, LLC and bidder shall be tried in Courts of Paris, Henry County, Tennessee. Successful purchasers agree to pay any and all reasonable attorneys' fees and costs incurred by Kail Auctions, LLC, the seller and/or their assigns, agents or employees in the commencement or defense of any action here-under as well as in the collection of any obligation here-under.
This auction is being conducted under appropriate state and local laws and the Uniform Commercial Code. Any additional terms or conditions of sale shall be announced prior to the auction. Bidding on any item indicates acceptance of these terms and conditions.
