Curless Family Farms, LLC is offering 135.13+/- acres for public auction to be held on Wednesday, September 27, 2023 @ 7:00 P.M. The auction will be held at the Town Square Community Centre located at 123 W Franklin Street, Winchester, IN 47394. The property rests on Maxville Road with exceptional road frontage and access. 8 mile creek runs through the property and offers an exceptional outlet for farm drainage. The White River runs on the north side of the property and extends across tracts 1 and 2. The property offers high quality tillable soils, hardwoods, and recreational wooded acreage. The property will be offered in three individual tracts, combinations, or it's entirety with a total of 135.13+/- acres and 100.37 +/- tillable acres. Process: The property will be offered in three individual tracts, combinations, or it's entirety with a total of 135.13+/- acres and 100.37 +/- tillable acres. There will be open bidding on the property determined by the Auctioneer. The successful bidder will receive the crop and planting rights for 2024 and will be granted possession of the property when the current farm tenant removes all of the 2023 crop. Down Payment: A 10% non-refundable down payment on the day of the auction will be collected on the total sale price. Down payment can be accepted in the form of cashier's check or good personal check. Bidding: The Seller reserves the right to accept or reject any and all bids. The successful bidder(s) will be asked to enter into a purchase agreement immediately following the conclusion of the auction. Bidding is not contingent upon buyer inspection or financing. If financing is required, please have financing arranged so that cash can be paid upon closing. Title and Warranty Deed: Seller agrees to furnish a complete abstract of title proving good and clear title of the real estate. Seller agrees to execute and deliver a good and sufficient Warranty Deed. Costs associated with the provision of owner's title insurance and title expense will be at the sole cost of the seller. Closing: The balance of the purchase price is due upon closing which will take place no later than 40 days after the auction date or upon completion of the seller's applicable closing documents. All costs incurred to obtain financing will be paid for by the buyer. Closing costs incurred for an administered closing shall be shared 50/50 between the buyer and seller. Closing will be administered at Rickert Title Company located at 125 S. Main Street Winchester, IN 47394. Closing of this transaction will be held no later than November 10, 2023 Possession: Possession will be granted at closing OR when the current tenant's crops are harvested if this occurs after closing. Real Estate Taxes: The buyer will assume the taxes due and payable in the Spring of 2024 and thereafter. The seller will pay the Fall 2023 due and payable taxes. Acreage and Survey: Acreage and dimensions are approximate based on county tax records and the Surety mapping system. If a survey is requested, it will be at the sole expense of the buyer(s). If the auction results have the property selling as individual tracts or a combination of tracts a survey will need to be completed and will be at the expense of the buyer or buyers.
