OFFER TO PURCHASE & TERMS AND CONDITIONS
1. The property is described as #48782 Yorke Line Malahide (Belmont) Ontario N0L 1B0. Part Lot 15,
Concession 7 Geographic Twp of South Dorchester, now Malahide Twp. Located in Elgin County shall
be sold as is, where is, subject to minimal reserve bid.
2. The highest bidder over the reserve shall be the purchaser. No person shall retract their bid.
3. The purchaser shall complete the sale on November 30th, 2023 when the balance of said purchase
money shall be paid unless previous arrangements have been made. HST if applicable will be in
addition to purchase price.
4. Advertised total acreage of 72 and tillable acreage of 60 is an approximate acreage and is not grounds
for dispute.
5. Immediately after the sale the purchaser shall sign a contract to complete the sale according to these
conditions.
6. All adjustments of insurance, rents, local improvement rates and other assessments to be apportioned
to the date of completion of sale, when possession shall be given.
7. The purchaser shall not be entitled to abstract or other evidence of title not in the possession of the
vendor and shall make any objections to the title in writing to the vendor’s solicitor within 15 days from
the date of auction, and in default of making any such objections the purchaser shall be deemed to
have accepted the title.
8. The purchaser agrees to accept title subject to any registered municipal agreements and any
easements for the supply of domestic utility or telephone services to the property of adjacent properties
or for drainage, storm or sanitary sewers, public utility lines or other services. If any objection shall be
made which the vendor shall be unable or unwilling to remove, the vendor shall be at liberty to rescind
the sale, and in such case the purchaser shall receive back the amount paid, without interest, in full
satisfaction of all claims.
9. The purchaser acknowledges that this property will be sold as is, where is, and that the vendor has not
made and warranty or representation whatsoever regarding the property or the buildings thereon,
including in relation to structural condition, water, sceptic, soil conditions, dimensions, acreage,
environmental condition, zoning or permitted future use.
10. If the purchaser fails to comply with the conditions aforesaid or any of them, the deposit and all other
payments made thereon shall be forfeited, and the property may be re-sold, and the deficiency, if any,
on such re-sale, together with all charges attending the re-sale, shall be made good by the defaulter.
11. Time shall be of the essence of these conditions.
