HWY 70 On-Line Auction Co. is not responsible for any missing or incorrect listing information; we attempt to provide accurate descriptions of all items in the auction. Provided descriptions are in good faith and are matters of opinion.
Payment in full is due at the conclusion of the auction.
At the conclusion of the auction, invoices will automatically be charged. If applicable, shipping and/or delivery costs will be charged separately approximately three business days after the auction end date.
Declined cards will be charged an additional $10 recharge fee, so please make sure the card you have on file with HiBid is correct and ready to receive the auction charges. If your card declines, you will receive an electronic invoice (with the additional fee) which will allow you to enter a alternative payment method in a secure environment, hosted by our credit card processor.
HWY 70 On-Line Auction Co. accepts the following forms of payment:
*Cashier's checks (For invoices $1,000 and above)

*Credit Cards (MasterCard and Visa.) Your Billing & Shipping address must match.
Merchandise becomes the full responsibility of the bidder at time of payment and the bidder assumes all risk of loss and damage to property at that time. HWY 70 On-Line Auction Co. reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
Buyer's Premium
There is a 13.5% Buyer's Premium in effect for this auction, which includes 3.5% Credit Card Fee, will be added to the high bid to determine the final sales price for the auction lot.
1. Disclaimer:
All lots sell as is, where is, with all faults. HWY 70 On-Line Auction Co. and the liquidator do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. HWY 70 On-Line Auction Co. encourages all bidders to preview lots in person before bidding or request additional information. HWY 70 On-Line Auction Co. is not responsible for incorrect listing information, if any. HWY 70 On-Line Auction Co. has attempted to provide accurate descriptions of all items; however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by HWY 70 On-Line Auction Co. staff are provided in good faith and are matters of opinion.
2. No Buybacks:
All sellers are contractually prohibited from bidding on lots they have consigned to the auction.
3. No Returns:
All sales are final. There are no returns, refunds, or adjustments.
It is important to remember auctions are not retail stores, Etsy, or E-bay. Auctions are held by licensed Auctioneers, with binding Terms & Conditions, and all sales are final.
4. Sales Tax:
HWY 70 On-Line Auction Co. will collect sales tax on all items in this auction, as required by TN state law.
If you are buying for resale and have a reseller certificate, please email your certificate.
5. Outbid Notification:
The on-line auction platform service provider will notify bidders when they have been outbid unless you have disabled in your preferences/profile.
6. Buyer Default:
If, after the Payment Period has ended, the Buyer does not make full payment in accordance with the terms set forth above, the Buyer is considered in default and their Auction Item(s) will be re-listed in an Online Auction and a 15% re-listing fee.
The acceptance of the Terms & Conditions implies you agree, the 15% re-listing fee, is a reasonable estimate of the minimum damages incurred by HWY 70 On-Line Auction Co. because of your failure to pay and will be charged to buyer.
The re-listing fee is based upon the original selling price of the Auction Item. By registering a valid credit card, with the on-line auction platform service provider, the Buyer authorizes HWY 70 On-Line Auction Co. to charge applicable re-listing fees to the credit card.
Abandonment: If paid items are not picked up or shipping requested (or paid) within the announced /published pick-up dates and times, their items will be considered abandoned and will be disposed of. Unfortunately, HWY 70 On-Line Auction Co. is not currently able to offer storage space.
7. Debt Collection and Interest Charges:
The bidder agrees to pay all reasonable attorney fees and other costs incurred by On The Spot Auction Company in its efforts to collect unpaid funds from the bidder. The bidder agrees to a fee of 2% of the outstanding balance per month be added to any unpaid balance due HWY 70 On-Line Auction Co. Any debt collection or dispute proceedings will be heard in Dekalb County, Tennessee.
8. Guaranty Agreement:
By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to HWY 70 On-Line Auction Co. of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee. Any debt collection or dispute proceedings will be heard in Dekalb County, Tennessee.
9. Limitation of Liability:
If, for any reason, HWY 70 On-Line Auction Co. is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of HWY 70 On-Line Auction Co., if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.
10. Age Requirement:
All bidders must be 18 years of age or older.
11. Shipping:
Shipping is available with $5 minimum S&H fee and will increase based on weight and insurance requirements. Includes $50 Insurance, if you require additional insurance (at your cost) please email and let us know. Packages are mailed with a tracking number and become your responsibility at the point the tracking number becomes active by the shipping carrier.
The better rate of USPS or UPS will be used.
***We offer home delivery to Rutherford Co, TN for $5, upon request. (under 50lbs).
Items not picked up will be shipped and you will be charged S&H Fees. If we are unable to ship (due to CC decline) items will be forfeited as outlined in the Terms & Conditions.
