Terms & Conditions
**LE GRANTE VENTE Auction House and Auction:**
1. LE GRANTE VENTE Auction House, herein referred to as the "Auctioneer," conducts auctions of Antiquities and Fine Art. The Auction is governed by these Terms and Conditions of Auction and complies with applicable state and local laws. Any announcements or corrections made during the auction supersede those in the printed catalog.
**Buyer?s Premium:**
2. All successful bids are subject to a Buyer?s Premium, which is in addition to the winning bid amount:
- For Antiquities and Fine Art Auction lots, the Buyer?s Premium is twenty-five percent (25%) on the first $300,000, subject to a minimum of $49 per lot, plus twenty percent (20%) of any amount between $300,000 and $3,000,000, plus fifteen percent (15%) of any amount over $3,000,000.
**Bidders:**
3. Any individual participating or registering for the Auction agrees to abide by and accept these Terms and Conditions of Auction ("Bidder(s)").
4. All Bidders must meet LE GRANTE VENTE's qualifications to bid. The Auctioneer reserves the right to disqualify any Bidder who does not meet the criteria at its sole discretion. Additionally, the Auctioneer may exclude any person from the auction.
5. If a corporate entity places a bid, the individual executing the bid on behalf of the entity agrees to personally guarantee payment for any successful bid.
**Credit:**
6. Bidders who have not established credit with LE GRANTE VENTE must either provide satisfactory credit information or supply valid credit card information, well in advance of the Auction. Internet bids will only be accepted from pre-registered Bidders. Credit will be granted at the discretion of the Auctioneer.
**Bidding Options:**
7. LE GRANTE VENTE accepts bids through various channels, including the Internet, telephone, fax, mail, and in-person through registered clients.
8. Bids in LE GRANTE VENTE Auctions may be placed as indicated in the auction catalog or on the website. Internet bids must be submitted by registered Bidders.
9. Bids must conform to specified increments. Any bids not meeting these requirements will be rounded to the nearest full or half increment.
10. LE GRANTE VENTE cannot be held responsible for errors in bidding or entry of bids. Bidders are advised to submit written bids well in advance of the Auction. Withdrawal of electronic bids may be permitted under certain conditions.
**Conducting the Auction:**
11. LE GRANTE VENTE reserves the right to accept or refuse any bid or to limit the amount of any bid at its sole discretion. Bids made by ineligible individuals or entities will not be considered.
12. The highest qualified Bidder acknowledged by the Auctioneer shall be the Buyer. In the event of a tie bid, preference is given to the earliest bid received. Auctioneer?s decision on winning bids is final and binding.

**Conducting the Auction (continued):**
16. The Auctioneer may, at its discretion, reject nominal bids, small opening bids, or very nominal advances.
17. Lots with bidding estimates will open at the discretion of the Auctioneer, typically starting at 40%-60% of the low estimate. If no bid meets or exceeds this opening amount, the lot may pass as unsold or the Auctioneer may place a protective bid on behalf of the consignor.
18. All items are sold per lot as numerically indicated, and no lots will be broken.
19. The Auctioneer reserves the right to rescind the sale in the event of non-payment, breach of warranty, disputed ownership, clerical errors, or for any other reason at the Auctioneer?s discretion.
20. In the event of Internet or server outages, or scheduled system downtime, bidding may be extended at the Auctioneer?s discretion. Bidders unable to place bids online should contact Client Services for assistance.
21. The Auctioneer, its affiliates, or their employees may consign items for sale and may bid on those lots or any other lots.
22. The Auctioneer may extend advances, guarantees, or loans to certain consignors.
23. The Auctioneer reserves the right to sell unsold items after the close of the Auction. Such sales are considered part of the Auction, and all Terms and Conditions apply.
**Payment:**
24. All sales are strictly for cash in United States dollars and subject to all reporting requirements. Payments may be made via various methods, including U.S. currency, bank wire, cashier's checks, traveler's checks, eChecks, and bank money orders. Payment by credit card (Visa, Mastercard, and Discover) is subject to prior approval by the Auctioneer and incurs a surcharge of 2.5%. Payment by eCheck, wire transfer, or check does not incur a surcharge.
25. Payment is due upon closing of the Auction session or upon presentation of an invoice. Failure to make payment within 7 days after the Auction close may result in voiding of the sale, and the Bidder remains obligated to pay Auctioneer fees and any damages.
26. Purchased lots may be subject to taxes or fees imposed by various jurisdictions, and it is the responsibility of the Buyer to pay these fees.

**Payment (continued):**
26. Purchased lots may be subject to taxes or fees imposed by various foreign taxing agencies. The Buyer is responsible for paying all foreign-imposed taxes, such as VAT or GST, prior to delivery unless other arrangements are made in writing. Lots delivered to the Buyer or their representative are subject to all applicable state and local taxes unless appropriate permits are on file with the Auctioneer. If state sales tax becomes applicable in the delivery state before the shipping date, the Buyer agrees to pay all applicable state sales tax. If sales tax is not properly collected due to various reasons, the Buyer agrees to pay the actual amount of tax due.
27. If Buyer's payment is dishonored upon presentment(s), Buyer shall pay the maximum statutory processing fee set by applicable state law. If payment cannot be completed using the selected funding source, Buyer agrees to complete payment using the credit card on file, subject to the surcharge detailed in paragraph 24.
28. If any Auction invoice submitted by the Auctioneer is not paid in full when due, the unpaid balance will bear interest at the highest rate permitted by law from the date of the invoice until paid. Any unpaid invoice will also bear a three percent (3%) late fee. The Buyer is liable for attorney?s fees, court costs, and other collection costs incurred by the Auctioneer if the invoice is referred to an attorney for collection.
29. In the event of non-payment, Auctioneer may charge the Buyer's credit card on file, sell the lot(s) securing the invoice to underbidders in the Auction or at a subsequent sale, or relist the lot(s) in a future auction. The defaulting Buyer is liable to pay any difference between the original invoice amount and the net proceeds from the sale of the lot(s), plus any applicable interest.
30. Title shall not pass to Buyer until all invoices are paid in full. Auctioneer shall have a lien against the purchased merchandise to secure payment of any outstanding Auction invoices. Auctioneer is further granted a lien against any other property of Buyer held by Auctioneer or its affiliates to secure payment of any Auction invoice or other amounts due.
**Delivery; Shipping; and Handling Charges:**
31. Buyer is responsible for all shipping, handling, registration, and renewal fees. Merchandise will be shipped promptly after payment is received. Auctioneer is unable to combine purchases from other auctions or affiliates into one package for shipping purposes.
32. Successful international Bidders shall provide written shipping instructions for any lots to be delivered outside of the United States.
33. The risk of loss during shipment will be borne by Auctioneer until delivery to the Secure Location. Buyer must report any loss or damage during transit within seventy-two (72) hours of delivery.
34. Buyer is responsible for arranging pick-up or shipping within ten days. Merchandise not removed within ninety days may be offered for sale to recover storage fees.
35. A. NOTICE OF CITES COMPLIANCE: Any property made of or incorporating endangered or protected species may have import/export restrictions. Buyer is responsible for obtaining all necessary information, licenses, and permits.
B. California State law prohibits the importation of any product containing Python skin into the State of California.
C. Auctioneer shall not be liable for loss caused by or resulting from seizure, destruction, or breakage of fragile articles.
**Shipping Verification and Returns:**
36. Requests for shipping verification for undelivered packages must be made within 30 days of shipment by the Auctioneer.
**Cataloging, Warranties, and Disclaimers:**
37. No warranty, whether expressed or implied, is made with respect to any description contained in this Auction or any second opinion. Any description of merchandise or second opinion contained in this Auction is solely for identifying merchandise for Bidders who do not have the opportunity to view merchandise prior to bidding. No description of merchandise has been made part of the basis of the bargain or has created any express warranty that merchandise would conform to any description made by the Auctioneer. Color variations are expected in any electronic or printed imaging and are not grounds for the return of any lot.
38. The Auctioneer sells only the right or title to merchandise being sold as the Auctioneer may have by virtue of consignment agreements on the date of the auction. The Auctioneer disclaims any warranty of title to the merchandise and disclaims any warranty of merchantability or fitness for any particular purpose.
39. Translations of foreign language documents may be provided as a convenience, but the Auctioneer makes no representation as to the accuracy of those translations.
40. The Auctioneer disclaims all liability for damages arising out of or in connection with the sale of any merchandise, and no third party may rely on any benefit of these Terms and Conditions. Any statement made by the Auctioneer is an opinion and does not constitute a warranty or representation.
41. The Auctioneer shall not be liable for breakage of glass or damage to frames, and such defects shall not be a basis for return or reduction in purchase price.
**Release:**
42. By participating in the Auction and placing a bid, Bidder releases the Auctioneer, its officers, directors, employees, affiliates, and outside experts from any and all claims, causes of action, whether at law or equity, arising from or related to the description or a derivative theory.
43. Some merchandise sold by the Auctioneer is inherently dangerous, and Buyer accepts all risk of loss or damage from its purchase of these items.
**Dispute Resolution, Arbitration, and Remedies:**
44. All claims, disputes, or controversies shall be exclusively heard by an arbitrator administrated by the American Arbitration Association, with the locale in Dallas, Texas. Exclusive subject matter jurisdiction for consumer claims is in the State District Courts of Dallas County, Texas.
45. Choice of law is Texas law, or Hong Kong law for auctions conducted by Heritage Auctions (HK) Limited.
46. The prevailing party may be awarded reasonable attorneys' fees and costs.
47. Any claim must be brought within two years, and Auctioneer's maximum liability is limited to the high bid on the lot.
48. These Terms & Conditions provide specific remedies, and Bidder agrees that any claim shall utilize such remedies.
**Miscellaneous:**
49. Agreements to effectuate a non-sale of an item, inhibit bidding, or utilize the Auction to obtain sales for non-selling consigned items are strictly prohibited.
50. Acceptance of these Terms and Conditions qualifies Bidder as a client who has consented to be contacted by Heritage in the future.
51. Rules of construction apply, and additional rules of specific venues are enforced.
**State Notices:**
Notice as to an Auction in California and Texas are provided, ensuring compliance with relevant state laws.

Terms A to O detail specific policies and procedures for coin and currency auctions, including return policies, grading standards, storage recommendations, and financing options.
