Luther Bros Auction Co. LLC - Terms and Conditions
Welcome to our auction. These Terms and Conditions govern your use of our auction services, including bidding on and purchasing items through our auction. By using our auction services, you agree to be bound by these Terms and Conditions.
Registration
To participate in our auction, you must register and create an account on our auction platform. During registration, you will be required to provide accurate and complete information. By registering for our auction, you represent and warrant that all information provided by you is accurate and complete.
Bidding
All bids are final and binding. By placing a bid, you agree to pay the full amount of your bid, plus any applicable buyer's premium and other fees. NC Taxes will be added to all sales unless you have a valid TAX ID# on file with us. We reserve the right to reject any bid at any time, for any reason.
Payment
Payment must be made in full within 24 hours of the close of the auction. Payments will be collected through the HiBid platform via credit card at the close of auction with card on file, unless otherwise agreed upon in writing. *** Note *** Items over $5,000 will require payment through bank wire, cash, or certified check. CC Payments will not be accepted over this amount.
Buyer's Premium
A buyer's premium of 15% will be added to the final bid price of all items sold, unless otherwise specified. The buyer's premium is non-refundable and is subject to change at any time.
Shipping and Pickup
Local pickup is available on Monday, May 20th from 12pm to 6pm at our auction warehouse located at 3013-G Hall Watters Dr in Wilmington NC 28405.
PICK UP IS ON PICK UP DAY, so unless you are having items shipped, please be prepared to come at the designated time. We cannot guarantee availability of staff at any other time besides pick up times. Late pickup will be charged $5 per lot / per day for storage ($10 PER LOT PER DAY for furniture). YOU ARE REQUIRED TO MAKE CONTACT with staff via email at Auctions@LutherBros.com if you are unavailable to pick up on pick up day and request an alternate day. Alternate day/time will be based upon availability of staff. We do not have space to store items, so we must move them around which uses labor and increases chances for loss and breakage. Failure to pick up items within 7 days after the auction closing time will result in items being considered abandoned. Abandoned items will become property of the auction company to be resold for storage fees without a refund. Failure to pick up items in a timely manner will result in restricted bidding privileges. Buyers purchasing large or heavy items, MUST bring appropriate vehicles and sufficient help to load.
Shipping
If you are requesting shipping, YOU ARE REQUIRED to make contact via email at Auctions@LutherBros.com to request shipping. $10 handling fee will be added to each lot that is shipped. Shipping and handling fee will be charged to credit card on file with HiBid separately. Items will be grouped when applicable for shipping. We are not responsible for any damage or loss incurred during shipping.
Disputes
In the event of any dispute between the buyer and seller, we will act as a neutral third party and will make a final determination on the dispute. Our decision will be final and binding.
Liability
We are not liable for any damage or injury incurred during the preview, bidding, or pickup process. By participating in our auction, you assume all risks and liabilities associated with these processes.
Modification
We reserve the right to modify these Terms and Conditions at any time, without notice. Your continued use of our auction services after any modification constitutes your acceptance of the modified Terms and Conditions.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina. Any legal action arising out of or in connection with these Terms and Conditions or our auction services shall be brought in the courts of New Hanover County (NC).
