Registered bidders agree to all terms and conditions as set forth by Auction House 282. All items are sold as is, where is, no guarantees expressed or implied. All bids are legal and binding, and once a buyer bids they accept all conditions stated herein. Once the items are sold, and or at the end of the auction bidders are expected to pay within the same day of the auction or upon receipt of the invoices. Auction House 282 and our staff describe items as accurately as we can however it is the responsibility of the customers to examine conditions and or authenticate as our descriptions should not be considered a guarantee or warranty. Bidders accept condition as viewed in the detailed pictures, in the absence of a condition description or additional report describing any flaws or less than perfect condition analysis. Bidders cannot rescind or reduce their bids. All sales are final - no refunds or returns for any reason/s to include shipping charges. Any changes to this agreement will be case by case and approved by the Auctioneer and Owner only. Auction House 282 reserves the right to remove and or add items at any time prior to and or during the auction. Auction House 282 reserves the right to refuse or deny services to anyone but does not discriminate by race, religion, or any personal beliefs or affiliations. Auction House 282 reserves to right to sell all items as preferred by the Auctioneer. Ownership of all items is transferred once the Auction ends and or is sold by the Auctioneer. Once item/s are sold, AH282 is not responsible for damages, lost or stolen items to include damages/ or losses during shipping. All winning bids will incur a 15% buyers premium, plus an additional 3% for credit/debit card use. Local pick-up can pay in cash upon pick-up and receive the in-house 15% buyers premium. Read "Picking up" terms described below. Picking Up: Payments are due The Tuesday and or Wednesday following the Auction even if picking up outside of these two days to avoid late charges/ Storage fees. NO EXCEPTIONS. All items must be picked up within 1 week of the close of auction including through appointments. Auction House 282 is closed on Sundays for operations and/or appointments. Any Items not picked up by the start of the next auction are deemed abandoned and will be resold unless pick-ups have been coordinated with Jason or Rachel. No Refunds. AUCTION HOUSE 282 AND ITS STAFF IS/ARE NOT RESPONSIBLE FOR DAMAGES OR INJURIES DURING LOADING WHETHER OR NOT WE ARE ASSISTING. NO EXCEPTIONS. YOU ATTEND AND ENTER, AND LOAD AT YOUR OWN RISK. Pick-ups are on designated days for each auction. Tuesdays and Wednesdays are the typical pick-up days following an auction. Auction House 282 reserves the right to change pick-up days when needed for any reason. Information will be added to our Facebook page so please check prior to leaving or arrival to pick up. You will not be penalized if we must change pick up days. SHIPPING: Shipping invoices are sent separate from Auction invoices. Oversized Items CANNOT be shipped. i.e., shelf units, furniture, heavy tools, oversized appliances, etc. If you MUST have your items shipped and AH282 agrees to ship, AH282 is not responsible for costs, damages, lost and or stolen packages for any and all items being shipped. The bidder who wants item/s shipped takes sole and total risk in items being shipped. All packages are insured for cost. This means NO DISPUTING, REFUNDS, EXCHANGES OR TRADES- NO EXCEPTIONS. If you are unsure if the item you are looking at is oversized, please contact Auction House 282 before bidding. We also cannot ship China/Glass lots or multiple breakable lots without prior AH282 Approval. Again, if you are unsure, please contact us prior to bidding. Due to the terms and conditions, payments must still made during the Tuesday and Wednesday during designated pick-up days and shipping charges must be able to be charged (or paid through Currency Pay) within 24 Hours (Close of business following day) of sent invoice for shipping. If you are unable to pick up any item(s), all terms and conditions still apply as far as late payments and storage fees. If we cannot ship the item/s, and the bidder/buyer does not contact us regarding shipping PRIOR TO THE END OF THE AUCTION, you are still required to pay for the items but will not be charged for the shipping. Reasons that an item may be deemed un-shippable may include size, shape, material, restricted items, items with age restrictions, hazardous materials, Fragile items etc. Auction House 282 reserves the right to make this determination at any time during the auction/shipping process. You must put "Shipping needed" in the notes to auctioneer or email Auction House 282 by the close of business the Friday following the close of the auction, your item will be deemed abandoned. Shipping invoice will be sent within 30 days of the end of the auction. * THERE ARE NO REFUNDS OR EXCHANGES FOR NEGLECTING TO ACTUALLY READ THESE TERMS AND CONDITIONS* THERE ARE A TOTAL OF 7 TO 10 DAYS ALL CUSTOMERS CAN ARRIVE, SCHEDULE APPOINTMENTS, MESSAGE, CALL AND CONTACT FOR QUESTIONS, TESTING, SEEING, LOOKING AT ITEMS PRIOR TO YOUR BIDDING. *The best method of contact is through email, calling the store may delay our response due to our open hours. AuctionHouse282@gmail.com Once payment is received, the buyer is free to choose to either have the items shipped or picked up at location. If an item is to be shipped the buyer will pay all costs associated including but not limited to insurance, shipping and handling. Auction House 282 will ship all items through USPS Priority Mail. In the event that an item is oversized and will not fit into a Priority Mail box, Auction House 282 ALWAYS reserves the right to ship the item through another provider at their discretion. There are no refunds, disputes or exchanges for ANY and ALL items being shipped. Any disputes are to be made between the customer and the shipping service being provided. Your packages are insured. If an item will be picked up at location, you may choose to pay by credit/ debit card, or cash *if during the two designated pick up days*. We do not accept checks. Payments must be received regardless of making appointments or If picking up outside of these two days and your card will be charged at the close of business day on the second designated pick-up day. If your card does not work, we will contact the buyer for payment. If payment is not received by the next day or within 24 hours of invoice being send, a late fee of $25 will be added with storage fees and must be paid prior to receiving items won at auction. Pick up will occur by appointment or during normal business hours as explained unless arrangements have been made with and agreed to by Auction House 282. Buyer must provide receipt with all paid items when picking up. For local pick-ups, please check our Facebook page for updated information in the event we must close for a pick-up day. We will always work with buyers on pick-ups and Facebook is our best communication route. Pick up must be made by COB, (close of business) the Wednesday following the end of auction, unless arrangements have been made through Auction House 282. If pick up or arrangements have not been made by close of business day Wednesday, the buyer will forfeit the item(s) won and all payments made for item/s. After Wednesday, storage fees/fees or reselling of the items will apply unless pick up arrangements have been accepted by Auction House 282. If fees are added, the fees must be paid prior to the buyer receiving their items. Items considered abandoned by Auctioneer will be resold to recoup costs associated with said fees. After pick-up arrangements have been made, items not picked will be forfeited, along with payments made unless the buyer contacts Auction House 282 24 Hours prior to arranged pick-up date and a new *agreement* has been made and accepted by Auction House 282. All items must be picked up within 1 week from the end of auction, no exceptions, or that item will be considered abandoned and re-listed in the next auction. All "no shows" or cancels during the scheduled pick up day (outside of the designated days) will result in forfeiture of all items and payments made. Restocking fees may apply for each item. To prevent restocking fees and or loss of items, the buyer or winning bidder must email 24 hours in advance or message through our Face Book messages for timestamp. (Explanation- If you schedule an appointment on any particular day and need to reschedule, you must email or Facebook message to reschedule. Auction House 282 does not have to accept a rescheduled appointment if it is past the week point of picking up items, so please attempt to keep any appointments made, especially outside of business hours.) If item is not paid by close of business day on Wednesday, Auction House 282 will charge the card on file for the full amount due. If payment is rejected a $25 late fee will be added onto the buyer's invoice. Each day after that, up to 30 days, a $5 storage fee will be added to the invoice. Storage fees also apply to any items that are left in the Auction House after pick up days. After 30 days of non-payment, the charge will be sent to collections. Please remember all bids are binding, and that if you are the winner of the item, payment must be made to avoid collections. There are no exceptions since our items are sold on consignment. In the event you refuse to pay for or abandon any item that you win at auction, Auction House 282 will have the option of reselling, removing, storing, or disposing of the unpaid or abandoned item. You understand and agree that you will be personally responsible for all deficiencies including all legal, collection, transportation, and storage expenses associated with your delinquent account and/or abandoned items. In the event of resale, you agree to pay any cost associated with the resale as well as any deficiency between your original purchase price and the resale price. Explanation: if an item is left unpaid, and resold for cheaper, you may be charged for the difference. Auction House 282 is not responsible for any deficiencies or misunderstandings or additional costs in regard to all items auctioned. Terms and Conditions are provided prior to registration. Any claim or controversy out of or relating to these Terms and Conditions, or to any breach thereof, will be settled either (A) in Comanche County, Oklahoma's Small Claims Court, if the claim in question amounts to less than $5,000, or (B) by means of arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, if the claim in question amounts to more than $5,000. In the event of arbitration, judgments upon the award rendered by the arbitrator may be entered by any court having jurisdiction. You agree that all claims will be litigated or arbitrated on an individual basis and will not be consolidated with any claim made by another party. Venue in every case will be Comanche County, Oklahoma. You agree that any judgments awarded may be applied to and collected from you personally or corporately. Should any party file an action contrary to this paragraph, the counterparty may recover reasonable legal fees and costs. Further, if you bring a claim against the Auctioneer and do not prevail, you agree that you will reimburse the Auctioneer for all reasonable legal fees and costs to include damages and loss of sales and storage fees. In all cases, the Auctioneer's liability, and the liability of the seller of the items in this auction, will be limited to the refund of your purchase price unless the item was shipped. In this case, there are no refunds for any reasons regarding any shipped items to include return shipping or costs associated with shipping. The Auctioneer will not be liable for any amount in connection with the postponement or cancellation of this auction, or the withdrawal of any item or lot from this auction. In no event will the Auctioneer be liable for lost profits or any special, incidental, or consequential damages arising out of or in connection with this auction or any related sale or transaction. (A) No Liability for the Acts of Third Parties: The Auctioneer is not responsible for any action taken by any seller, bidder, or other third party before, during, or after this auction. (B) No Liability for Site Malfunction: You understand that this auction is online-only, and so relies on devices and programs that may malfunction without warning. You agree that the Auctioneer will not be liable for any error or inconvenience that may be the result of such a malfunction. You further understand and agree that the Auctioneer may void or suspend any sale, or resell any item, if the Auctioneer determines a transaction to have been affected by any site malfunction. The buyer or bidder who registered is responsible to pay for any costs, bids or items You agree to indemnify, defend, and hold harmless the Auctioneer and its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives including, but not limited to, personal injury or property damage caused at any sales site or during removal or transportation of items won at auction, any dispute with another bidder, or any violation of these Terms and Conditions. If any term, provision, paragraph, condition, or other portion of this agreement, or the application of these, to any person, place, or circumstance, is held to be invalid, unenforceable, or void, the remainder of this agreement and such term, provision, covenant or condition as applied to other persons, places and circumstances will remain in full force and effect. At the time of a bid placed, that shows agreement to all terms herein.
