No Buyers Premium GELDINGS ARE A TAXED ITEM PER WA STATE LAW Live auction with webcast and online bidding. Pre-Bidding will open at 9 am(pst) Tuesday, July 27th Lots will close with live auction. Live auction begins at 1pm(pst), Sunday, August 1st, 2021. You are responsible and liable for all bids you place live or online. We do not retract bids. Guaranteed sound- A horse is only sold as guaranteed sound if the seller states it in the advertisement. Buyers will have 48 hrs to have the horse examined by a licensed veterinarian after purchase. If being sold Guaranteed Sound, the buyer will need to make any disputes against this guarantee within 48 hrs with proper records from a veterinarian to ESP. If sold without a soundness guarantee, buyers are only able to dispute sales of horses that develop signs of a serious infectious disease within this 48 hr period with proper records from a veterinarian. If a horse is sold As Is, it does not mean that there is anything wrong with the horse. There are several reasons why a seller might not guarantee a horse sound, such as traveling a long distance that makes picking the horse back up if the buyer backs out of the sale difficult, not being able to wait the 48hrs to receive their check, etc. All horses sell "AS IS" unless otherwise noted in their description.

SOUNDNESS GUARANTEE - Horses are sold either AS IS or GUARANTEED SOUND Guaranteed sound means the following: The horse MUST be examined by a licensed veterinarian. The policy covers - eyes, heart and the horse must trot sound on all four legs 50 yards back and forth. Bloodwork can be pulled at this time for any evidence of pain relieving drugs. You have until 5 pm on Tuesday to have the results into our office, obviously, blood work will take longer but as long as the bloor has been drawn in that period of time, you will have protection if the bloodwork results in any questionable results. THE FOLLOWING APPLIES TO ALL EQUINE. Enumclaw Sales Pavilion (ESP) is the AGENT between the buyer and seller. What is listed in the description of the equine is all that is known by ESP. This information is provided by the owner of the horse and any & all guarantees are given BY THE OWNER. NO SHOW FEE: For any horse that is a no show at our auction we will charge the seller a $500 fee. This fee can be waived if a vet provides documents that the horse is not sound on the day of the sale. ESP provides the listing only and makes no guarantees and is not liable for sellers misrepresentation. ****Buyers do your own due diligence.**** No one is allowed to enter into a horse's pen without the seller's permission. The buyer is the responsible party to examine horses carefully before they bid. Payment is due DAY OF AUCTION. Horses can be boarded for up to 5 days after the auction at the buyer's expense. Boarding Fees - $10 per horse, per day. Any horse not paid for within 5 days of the auction is considered abandoned and will become the property of ESP. Buyer remains responsible for the invoice balance due on their purchase(s). If payment is not made ESPwill mitigate their losses (resell the purchase(s)) and the buyer who abandoned their purchase will be liable for the difference in invoice prices. All animals are the buyer's responsibility as soon as the auctioneer states they are sold in the ring. ESP is NOT RESPONSIBLE for any injury and/or illness after the animal is sold. ***We accept cash, credit or debit card (4% surcharge for credit)*** Arrange all pickup and shipping details with the office. REMOVAL OF ITEMS/SHIPPING & HOLD HARMLESS: The buyer is solely responsible for removal and shipping of their own purchases. HOLD HARMLESS: The purchaser hereby agrees to indemnify and hold harmless ESP and the seller, against any and all liability, loss, costs, damages and other expenses arising from loading out of items by ESP on the purchaser's behalf. All lots must be removed within the times noted in these terms and conditions. No one is allowed to enter into a horse's pen without the seller's permission. The ESP is an equine facility and all actions and activities are subject to the Equine Inherent Law. By your presence on these grounds, you have indicated that you have accepted the limits of liability resulting from inherent risk of equine activities. Liability: Buyers, sellers, and spectators are cautioned to exercise care while attending the sale and enter premises at their own risk according to the laws of the State of Oregon. Neither the owners nor any other persons connected with this sale assume any liability, legal or otherwise, for accidents to persons or property, before, during, or after the sale. ESP its principals, directors, officers, agents, employees and volunteers, and each and every landowner, municipal and/or government agency upon whose property this activity is conducted, shall not be liable for injuries sustained by anyone attending the Horse Sale.
