"My name is Ron Mullennix. I am an attorney representing Citizens Bank & Trust in their capacity as Trustee of the Bunnell Family Trust. As part of the auction information packet, you have been furnished a title insurance commitment from Thomson-Affinity Title. That report shows no encumbrances on the property other than a First Deed of Trust held by US Bank which would be paid in full from the sales proceeds. We need to advise you that yesterday morning, with no prior notice to the Trustee, a Notice of Lis Pendens was filed with the Recorder of Deeds for Platte County stating that this property is the subject of a lawsuit filed by one Evelyn Cochran. Citizens Bank & Trust has not been served in that lawsuit, but it is my opinion that the lawsuit is without merit and is based on erroneous statements of fact and what I believe are false allegations. We believe it is simply an attempt to extract money from the Bunnell Trust by placing a cloud on the title to this real estate. We firmly believe that Ms. Cochran’s suit will not be successful. Nevertheless, we feel that we must make you aware of this most recent development which may possibly affect the closing date for the sale. If I were a bidder, this would not impact my willingness to bid on the property, but each of you must make your own decision on that."
