LOADING: If you are the winning bidder for large items, please bring help & equipment to load the item.
BID INCREMENTS:
You may put in your maximum bid and the computer will place your bids for you in the following increments:
$0 - $25 = $1
$25 - $50 = $2
$51 - $500 = $5
$500 - $2000 = $25
$2001 - + = $100
All items sell "as is, where is" with no guarantees or warranties express or implied.
Soft Close:
A "Soft Close" ending for a property means that if a bid is placed in the last 2 minutes, the bidding for that property will be extended by another 2 minutes. This gives other interested bidders time to raise their bid before the lot closes.
Lot Stagger:
Each lot will end 20 seconds apart. That means that Lot 1 will end at 7:00:00 Lot 2 will end at 7:00:20 Etc.
JURISDICTIONS:
The respective rights and obligations of the parties with respect to the Terms and Conditions of Sale and the conduct of the auction shall be governed and interpreted by the laws of Rutherford County in the State of Tennessee. By bidding at an auction, whether present in person or by agent, by written bid, or other means, the buyer shall be deemed to have consented to the jurisdiction of the state and federal courts sitting in Rutherford County, Tennessee. Buyer/Bidder agrees to hold harmless and indentify Durham Realty & Auction Co., Inc. and its Agents & Representatives from any & all claims or suites including, but not limited to awards, judgments, cost & fees.
IDENTIFICATION:
All buyers are required to have a Bidder's Number to bid, giving full name, address, phone number, and Email address. Bidders are responsible for any & all actions involved in their account. If your USER NAME is offensive to Durham Realty & Auction Co., Inc. then we reserve the right to terminate your bidding. Durham Realty & Auction Co., Inc. has agreements with various individuals and corporations, etc ("Sellers") to market certain property through an internet bidding platform or other means necessary to generate a successful bid for the property. All property offered at Durham Realty & Auction Co., Inc. shall be offered subject to the Sellers' approval of the price and final terms and conditions. The Items shall be offered through an internet bidding process with a specified opening and closing date.
DEFAULT:
If purchases are not settled on the specific pick up day, it will be considered in default. If in default the bidder will be blocked from all future Durham Realty & Auction Co., Inc. auctions. All defaulted Items may be offered to the next highest qualified bidder at our discretion.
SERVER, SOFTWARE, & TECHNICAL ISSUES:
In the event there are technical difficulties related to the server, software, or any other online auction related technologies, DURHAM REALTY & AUCTION CO., INC. reserves the right to close, continue, or extend bidding. Neither Auction Flex nor DURHAM REALTY & AUCTION CO., INC. shall be held responsible for any missed bid, or failure of the software to function properly
